CHAPTER Mid 200 PROCEDURAL RULES

REVISION NOTE:

Document #14497, effective 2-8-26, repealed Part Mid 201 through Part Mid 217 in Chapter Mid 200, titled “Procedural Rules”. This action was taken pursuant to 2023, 212:23, effective October 3, 2023, which repealed RSA 326-D:4, I(b) and (c), RSA 326-D:5, III, and RSA 326-D:8, I and III. Document #14497 also adopted a new Part Mid 201 titled “Applicability and Waiver of Substantive Rules”, containing Mid 201.01 titled “Applicability of Plc 200.”

Document #14497 replaces all prior filings affecting the rules in the former Chapter Mid 200. The prior filings included the following documents. Italics indicate the rules were subject to expiration only pursuant to RSA 541-A:17, II:

As practice and procedure rules, the rules in Document #14497 will not expire except pursuant to RSA 541-A:17, II.

PART Mid 201 APPLICABILITY AND WAIVER OF SUBSTANTIVE RULES

Mid 201.01 Applicability of Plc 200. The Plc 200 rules shall govern the midwifery council with regards to all procedures for:

(a) The receipt and investigation of misconduct complaints;

(b) The conduct of adjudicative and non-adjudicative proceedings;

(c) Rulemaking submissions, considerations, and dispositions of rulemaking petitions;

(d) Public comment hearings;

(e) Declaratory rulings;

(f) Explanation of adopted rules;

(g) Voluntary surrender of licenses; and

(h) Waivers.
