CHAPTER Fis 1100 LICENSES AND PERMITS

REVISION NOTE:

Document #8183, effective 9-28-04, adopted, repealed, readopted and renumbered, or readopted with amendments and renumbered most of the rules in Chapter Fis 1100, some of which had expired. The chapter has been re-named “Licenses and Permits” instead of “Permits.” Document # 8183 also renumbered, but did not readopt, existing rules Fis 1102.15 as Fis 1102.05, Fis 1102.20 as Fis 1102.08, and Fis 1102.21 as Fis 1102.09. Many rules in Document #8183 had formerly been in Fis 1200, some of which had expired. Document #8183 replaces all prior filings for rules in Chapter Fis 1100, except for the existing rules Fis 1102.05, Fis 1102.08, and Fis 1102.09, which retain their last effective date as indicated in the source notes.

PART Fis 1101 HUNTING AND FISHING LICENSES

Fis 1101.01 Multi-license Form.

(a) An applicant for any of the following resident license types shall complete and submit the “Application for Licenses” form, Rev 10/23, available at printable-license-app.pdf (nh.gov), to the department at 11 Hazen Drive, Concord, NH 03301, a regional office, or an agent location, in accordance with Table 1100.1 below, together with the fee as determined in accordance with Fis 1110.01:

(b) An applicant for any of the following nonresident license types shall complete and submit the “Application for Licenses” form, Rev 01/23, available at printable-license-app.pdf (nh.gov), in accordance with Table 1100.2 below, to the department headquarters or an agent location, together with the required fee as determined in accordance with Fis 1110.02:

(c) Every applicant shall also provide a copy of his or her current state issued motor vehicle driver license or state issued non-driver photo identification card which shall be used to determine if the applicant qualifies for status as a resident of New Hampshire, pursuant to RSA 214:11-a and Fis 1109.12.

(d) Every applicant for a firearm hunting license shall also present written proof of completion of a hunter education safety instruction course from this or any other state or Canadian province, or a previously held firearm hunting license issued by this or any other state or Canadian province, pursuant to RSA 214:23-a, I and Fis 1109.13.

(e) Every applicant for an archery hunting license shall also present written proof of completion of a bowhunter education safety instruction course from this or any other state or Canadian province, or a previously held archery hunting license issued by this or any other state or Canadian province, pursuant to RSA 214:23-a, II and Fis 1109.13.

(f) On the form required by (a) or (b) above, the applicant shall make the following affirmation, pursuant to RSA 214:18-b: “I certify that my privileges to fish, hunt, trap, guide, take lobsters, or engage in commercial marine fishing activities are not under suspension or revocation in any state or province, and further certify that I am aware that any conviction of certain felonies in any state or province prohibits the possession of a firearm or other dangerous weapon.”

(g) On the form required by (a) or (b) above, the applicant may elect to make a voluntary contribution to the nongame program of the department or the wildlife legacy fund of the department, which shall be paid along with the fee for the requested license(s).

(h) If submitted to the department by mail to 11 Hazen Drive, Concord, NH 03301, the applicant shall also enclose a business sized, stamped, self-addressed envelope to allow return of the license document by mail.

Fis 1101.02 Special Resident Milestone License.

(a) An applicant for the special license for residents of New Hampshire born prior to January 1, 1948 shall complete and submit the “Application for Special Resident Milestone Licenses” form, Rev 01/23, available at over-68-app.pdf (nh.gov), in accordance with Table 1100.3 below, to the department, together with the required fee as determined in accordance with Fis 1110.07:

(b) Every applicant shall also provide a copy of his or her current state issued motor vehicle driver license or state issued non-driver photo identification card which shall be used to determine if the applicant qualifies for status as a resident of New Hampshire pursuant to RSA 214:11-a and Fis 1109.12.

(c) Every applicant for a firearm hunting license shall also present written proof of completion of a hunter education safety instruction course from this or any other state or Canadian province, or a previously held firearm hunting license issued by this or any other state or Canadian province pursuant to RSA 214:23-a, I and Fis 1109.13.

(d) Every applicant for an archery hunting license shall also present written proof of completion of a bowhunter education safety instruction course from this or any other state or Canadian province, or a previously held archery hunting license issued by this or any other state or Canadian province pursuant to RSA 214:23-a, II, and Fis 1109.13.

(e) On the form required by (a) above, the applicant shall make the following affirmation pursuant to RSA 214:18-b: “I certify that my privileges to fish, hunt, trap, guide, take lobsters, or engage in commercial marine fishing activities are not under suspension or revocation in any state or province, and further certify that I am aware that any conviction of certain felonies in any state or province prohibits the possession of a firearm or other dangerous weapon.”

(f) On the form required by (a) above, the applicant may elect to make a voluntary contribution to the nongame program of the department or the wildlife legacy fund of the department, which shall be paid along with the fee for the requested license(s).

(g) The special resident milestone license shall be effective as long as the applicant remains a resident of New Hampshire, unless otherwise revoked or suspended.

(h) The applicant shall only acquire the license in person, by mail from the department at 11 Hazen Drive, Concord, N.H. 03301, in person at a regional office or at select agent locations, or by downloading from the department’s website. If submitted to the department by mail, the applicant shall also enclose a business sized, stamped, self-addressed envelope to allow return of the license document by mail.

Fis 1101.03 Lifetime License.

(a) An applicant for the resident lifetime license shall complete and submit the “Resident Lifetime License Application” form, Rev 01/23, available at lifetime-license-app.pdf (nh.gov), to the department, together with the required fee in accordance with Table 1100.4 below:

(b) An applicant for newborn lifetime combination hunting and fishing license gift certificate shall complete and submit the “Newborn Lifetime Combination Hunting and Fishing License Gift Certificate Application” form, Rev 01/2023, available at newborn-app.pdf (nh.gov), to the fish and game department in person or by mail to 11 Hazen Drive, Concord, N.H. 03301, together with:

(1) The required fee of $304.50, being the license fee of $300, pursuant to RSA 214:9-c, I(b)(2), together with the habitat fee of $2.50 imposed by RSA 214:1-f, I, the fish habitat fee of $1.00 imposed by RSA 214:1-g, I, and the agent fee of $1.00 imposed by RSA 214-A:4, I;

(2) A certified copy of the child’s birth certificate, showing a date of birth that is less than one year prior to the date the application is received by the department;

(3) A copy of one parent’s New Hampshire driver’s license, or New Hampshire issued non-driver photo identification card; and

(4) An acknowledgement that the gift certificate shall not be transferable for the use of any other person or refundable to the applicant or any other person for any reason.

(c) Every applicant for issuance of a lifetime license shall also provide a copy of his or her current state issued motor vehicle driver license or state issued non-driver photo identification card which shall be used to determine if the applicant qualifies for status as a resident of New Hampshire, pursuant to RSA 214:11-a and Fis 1109.12.

(d) Every applicant for issuance of a lifetime firearm hunting license shall also present written proof of completion of a hunter education safety instruction course from this or any other state or Canadian province, or a previously held firearm hunting license issued by this or any other state or Canadian province, pursuant to RSA 214:23-a, I and Fis 1109.13.

(e) Every applicant for issuance of a lifetime archery hunting license shall also present written proof of completion of a bowhunter education safety instruction course from this or any other state or Canadian province, or a previously held archery hunting license issued by this or any other state or Canadian province, pursuant to RSA 214:23-a, II and Fis 1109.13.

(f) The applicant shall only acquire the license in person, by mail from the department at 11 Hazen Drive, Concord, N.H. 03301, or by downloading from the department’s website. Fis 1101.04 Nonresident Honorary Hunting and Fishing.

(a) An applicant for a nonresident honorary fishing, or hunting and fishing license shall complete and submit an “Application for the New Hampshire Fish and Game Department Nonresident Honorary License” form, Rev 1/2023, available at nonres-honorary-license.pdf (nh.gov). The applicant shall only acquire the license in person or by mail from the fish and game department, 11 Hazen Drive, Concord, N.H. 03301.

(b) All such applicants shall provide documentation showing:

(1) Active membership in the New England Outdoor Writers Association (NEOWA) or the Outdoor Writers of America Association (OWAA); or

(2) Active employment on the staff of a newspaper, magazine, newsletter, or outdoor hunting or fishing related radio or television program, whether in electronic or traditional print format.

(d) On the form required by (a) above, the applicant shall make the following affirmation pursuant to RSA 214:18-b: “I certify that my privileges to fish, hunt, trap, guide, take lobsters, or engage in commercial marine fishing activities are not under suspension or revocation in any state or province, and further certify that I am aware that any conviction of certain felonies in any state or province prohibits the possession of a firearm or other dangerous weapon.”

Fis 1101.05 Complimentary for Certain Disabled Persons.

(a) An applicant for a paraplegic hunting and fishing license shall complete the top portion of the “Application for a N.H. Fish and Game Paraplegic License” form, Rev 01/23, available at paraplegic-license.pdf (nh.gov).

(b) On the form required by (a) above, the applicant shall make the following affirmation:

(1) Pursuant to RSA 214:18-b: “I certify that my privileges to fish, hunt, trap, guide, take lobsters, or engage in commercial marine fishing activities are not under suspension or revocation in any state or province, and further certify that I am aware that any conviction of certain felonies in any state or province prohibits the possession of a firearm or other dangerous weapon.”;

(2) “I certify that I am a resident of the State of New Hampshire as defined in RSA 207:1, XXIII, and that I do not claim residence in any other state for any purpose.”; and

(3) “I understand that this is a permanent license that shall be valid as long as I remain a resident of New Hampshire as defined in RSA 207:1, XXIII.

(e) The applicant shall have the bottom portion of the form completed by a physician or advanced practice registered nurse practitioner familiar with his or her medical condition.

(f) When both portions of the form have been fully completed, the applicant shall submit it in person or by mail to the fish and game department at 11 Hazen Drive, Concord, NH 03301, together with a one-time administrative fee of $10.00. If submitted to the department by mail, the applicant shall also enclose a business sized, stamped, self-addressed envelope to allow return of the license document by mail.

Fis 1101.06 Temporary License – Active Duty Army, Navy, Marines, Air Force and Coast Guard.

(a) An applicant for a temporary license for an active duty member of the army, navy, marines, air force, or coast guard shall complete and submit the “Application for NH Fish and Game Department Temporary License Active Duty Armed Forces and Coast Guard” form, Rev. 1/2023, available at active-duty-military.pdf (nh.gov).

(b) On the form required by (a) above, the applicant shall make the following affirmation:

(2) “I certify that I am a resident of the State of New Hampshire as defined in RSA 207:1, XXIII, and that I do not claim residence in any other state for any purpose.”; and

(3) “I understand that this is a temporary license that shall be valid as long as I remain an active duty member stationed outside of New Hampshire.

(c) Every applicant shall also provide a copy of the following to determine if the applicant qualifies for status as a resident of New Hampshire pursuant to RSA 214:11-a and Fis 1109.12:

(1) Current military orders showing the applicant to be a resident of New Hampshire who is stationed outside of New Hampshire; or

(2) A current New Hampshire issued motor vehicle driver license or state issued non-driver photo identification card and current military orders showing the applicant is stationed outside of New Hampshire.

(e) The license shall expire on the occurrence of any of the following events:

(1) The applicant is no longer on active duty status in any of the named armed services;

(2) The applicant is no longer a resident of New Hampshire;

(3) The applicant is stationed by the armed services within New Hampshire; or

(4) One year from the date of issue.

(f) The applicant shall submit the above noted application and supporting documents in person or by mail to the fish and game department at 11 Hazen Drive, Concord, NH 03301. If submitted to the department by mail, the applicant shall also enclose a business sized, stamped, self-addressed envelope to allow return of the license document by mail.

Fis 1101.07 Permanently Disabled Veterans License.

(a) An applicant for a permanently disabled veterans license pursuant to RSA 214:13, I shall complete and submit an “Application for New Hampshire Disabled Veterans License” form, Rev. 01/23, available at disabled-veterans-license.pdf (nh.gov).

(b) On the form required by (a) above, the applicant shall make the following affirmation:

(2) “I certify that I am a resident of the State of New Hampshire as defined in RSA 207:1, XXIII, and that I do not claim residence in any other state for any purpose.”; and

(3) “I understand that this is a permanent license that shall be valid as long as I remain a resident of New Hampshire as defined in RSA 207:1, XXIII.

(d) The applicant seeking a permanently disabled veteran’s license shall submit with the form required by (a) above:

(1) A copy of an award letter from the U.S. Department of Veterans Affairs showing a service connected permanent disability rating of 100%;

(2) Proof of discharge other than dishonorable from an armed service;

(3) A $10.00 one-time administrative fee; and

(4) The appropriate resident license fee for any additional license type requested, computed in accordance with Fis 1110, which shall be due and payable on an annual basis.

(e) Every applicant for a firearm hunting license shall also present written proof of completion of a hunter education safety instruction course from this or any other state or Canadian province, or a previously held firearm hunting license issued by this or any other state or Canadian province, pursuant to RSA 214:23-a, I and Fis 1109.13.

(f) Every applicant for an archery hunting license shall also present written proof of completion of a bowhunter education safety instruction course from this or any other state or Canadian province, or a previously held archery hunting license issued by this or any other state or Canadian province, pursuant to RSA 214:23-a, II and Fis 1109.13.

(g) The applicant shall submit the above noted application and supporting documents in person or by mail to the fish and game department at 11 Hazen Drive, Concord, NH 03301. If submitted to the department by mail, the applicant shall also enclose a business sized, stamped, self-addressed envelope to allow return of the license document by mail.

Fis 1101.08 Permanent Disabled Crossbow Permit.

(a) An applicant for a permanent disabled crossbow permit shall complete the top portion of the “Permanent Disabled Crossbow Permit” form, Rev. 01/23, available at disabled-crossbow-permit.pdf (nh.gov).

(b) The applicant shall have the bottom portion of the form completed by a physician or advanced practice registered nurse practitioner familiar with his or her medical condition.

(c) When both portions of the form have been fully completed, the applicant shall submit it in person or by mail to the fish and game department 11 Hazen Drive, Concord, NH 03301, together with a one-time administrative fee of $10.00.

(d) No holder of a permanent disabled crossbow permit shall:

(1) Use a conventional longbow, recurve bow, or compound bow while hunting in New Hampshire;

(2) Hunt in New Hampshire without the appropriate hunting or archery license for that season; or

(3) Be exempted from the application of any other provision of these rules relative to the hunting of game species in New Hampshire.

Fis 1101.09 Apprentice Hunting License.

(a) An applicant for any of the following resident apprentice hunting license types shall complete and submit the “Application for Apprentice Hunting License” form, Rev 01/23, available at apprentice-hunting-app.pdf (nh.gov), in accordance with Table 1100.5 below, together with the required fee as determined in accordance with Fis 1110.01:

Fis 1101.10 Nonresident Full-Time New Hampshire Student License.

(b) Every applicant shall also provide a copy of the following to determine if the applicant qualifies for non-resident full time student status;

(1) A current valid student identification card issued by a New Hampshire public or private high school, post graduate program, or post-secondary educational institution; and

(2) A copy of the courses for which the student is currently registered, together with the credit hours assigned to each, to verify a course load of at least 12 credit hours.

(c) On the form required by (a) above, the applicant shall make the following affirmation pursuant to RSA 214:18-b: “I certify that my privileges to fish, hunt, trap, guide, take lobsters, or engage in commercial marine fishing activities are not under suspension or revocation in any state or province, and further certify that I am aware that any conviction of certain felonies in any state or province prohibits the possession of a firearm or other dangerous weapon.”

(f) On the form required by (a) above, the applicant may elect to make a voluntary contribution to the nongame program of the department or the wildlife legacy fund of the department.

(g) The applicant shall only obtain the license in person or by mail from the department at 11 Hazen Drive, Concord, NH 03301. PART Fis 1102 HUNTING AND OTHER GAME LICENSES AND PERMITS

Fis 1102.01 NH Special Wildlife Permit.

(a) Any person wishing to possess moose or other protected wildlife under RSA 207:21, RSA 208:9, or RSA 208:14, shall obtain a NH special wildlife permit from a department conservation officer in order to possess wildlife.

(b) Applicants shall provide the following:

(1) The type and number of the license, if applicable;

(2) The species to be possessed or transported out of state;

(3) Where transported and the date of such transportation;

(4) The date and town where wildlife was killed;

(5) The sex, weight, and place of storage of wildlife;

(6) The name, address, and signature of the person who killed the wildlife, or in the case of a minor, the signature of the accompanying adult;

(7) Dated signature, signed subject to the penalty for making unsworn false statements pursuant to RSA 641:3;

(8) The cause of death; and

(9) Acknowledgment receipt of the wildlife species received relieving the New Hampshire fish and game department and its employees of any liabilities relative to the suitability for human consumption.

Fis 1102.02 NH Wildlife Permit for Wildlife Killed by a Motor Vehicle.

(a) A resident who desires to possess wildlife that has been accidentally killed by a motor vehicle shall:

(1) Complete a “N.H. Wildlife Permit for Wildlife Accidentally Killed by Motor Vehicle” form, Rev 10/18, obtained from a department conservation officer or a New Hampshire law enforcement officer. Once complete the form shall be submitted directly to a conservation officer for approval; or

(2) If no law enforcement officer is available, the information shall be provided to the dispatch center of the department by telephone at 603-271-3361, who will provide instructions for further action required to obtain approval to continue to possess the wildlife.

(b) Upon receipt of a form, the conservation officer shall review the form, and if all requested information has been provided, shall approve it, and provide one copy to the applicant that shall be kept with the meat possessed.

(c) The permit shall be valid for a period of 6 months, but shall be extended for one additional period of 6 months upon the request of the permittee.

Fis 1102.03 Hunting from a Motor Vehicle.

(a) An applicant for a permit to hunt from a motor vehicle shall complete and submit an “Application for a NH Fish and Game Hunt From a Motor Vehicle Permit” form, Rev. 1/2023 and available at hunt-motor-vehicle.pdf (nh.gov), and:

(1) Submit a letter from a physician verifying the applicant as a disabled person, as described in RSA 207:7-a, who is suffering from paraplegia or who is suffering from the loss of, or the loss of use of, both lower extremities;

(2) Provide a current hunting license, or a permanent paraplegic hunting license issued ursuant to Fis 1101.05;

(3) Submit a one-time administrative fee of $10.00; and

(4) Affirm pursuant to RSA 214:18-b: “I certify that my privileges to fish, hunt, trap, guide, take lobsters, or engage in commercial marine fishing activities are not under suspension or revocation in any state or province, and further certify that I am aware that any conviction of certain felonies in any state or province prohibits the possession of a firearm or other dangerous weapon.”.

(b) The applicant shall only acquire the license in person or by mail from the department at 11 Hazen Drive, Concord, NH 03301. Fis 1102.04 Baiting Wildlife.

(a) A person may bait wildlife in accordance with RSA 207:3-d on lands other than their own, only after obtaining permission in writing to do so from the owner or occupant of the land where baiting is to be done. Said permission shall be obtained using a “Permit to Bait Wildlife” form supplied by the department or obtained from the department’s website, www.wildlife.state.nh.us .

(b) An applicant for a permit to bait wildlife shall supply the following on the “Permit to Bait Wildlife” form:

(1) The name of the permittee;

(2) The address of the permittee;

(3) The telephone number of the permittee;

(4) The date of birth of the permittee;

(5) The species for which baiting will be allowed;

(6) An indication as to whether the bait site is for private use or commercial use by a licensed N.H. hunting guide;

(7) An indication as to whether the bait site is on lands other than state owned or managed land as described in Fis 307.01, or on state owned or managed lands as described in Fis 307.05;

(8) An indication whether the bait site being applied for was awarded during the Connecticut Lakes Headwaters Forest lottery and if so, the trapping unit number in which the site is located;

(9) The location of the land where baiting is to be allowed and described by the WMU as described in Fis 301.02, town, road, and property name or White Mountain National Forest District and trapping unit if on state owned or managed lands;

(10) Directions to the exact location of the bait site;

(11) Any stipulations to placing bait, listed by the landowner or land occupant;

(12) Name and address of the landowner or land occupant printed in a legible manner;

(13) Telephone number of the landowner or land occupant;

(14) Date of issuance; and

(15) The signature of the landowner or land occupant or, if public land, of the proper authority.

Fis 1102.06 Bear Guide Permit.

(a) To be eligible to apply for a bear guide permit, a completed “Guide’s License Application” pursuant to Fis 1301.03, for hunting shall be received at the department’s licensing division by 3:30 p.m. on the third Friday in December, or be postmarked by the second Friday in December, in the year immediately prior to the year for which the bear guide permit is sought.

(b) A New Hampshire licensed guide shall complete and submit a “Permit to Guide Bear” application, Rev 7/25, available at https://www.wildlife.nh.gov/document/permit-guide-bear-application, to the department by providing the following:

(1) Name, address, telephone number, and date of birth of applicant;

(2) Type of guiding, whether with dogs, over bait, stalking, or still hunting;

(3) An indication of whether the applicant seeks a group A or B bear guide permit; and

(4) Signature of applicant, signed subject to the penalties for making unsworn false statements under RSA 641:3.

(c) Illegible or incomplete applications shall not be considered. Corrected applications may be resubmitted by the deadlines specified below.

(d) Permits shall be non-transferable.

(e) Permits shall expire on December 31st each year.

(f) A maximum of 50 bear guide permits, split into group A permits and group B permits, shall be issued per year.

(g) The following criteria shall apply to the issuance of group A bear guide permits by the department:

(1) A maximum of 25 group A bear guide permits shall be issued by the department;

(2) Applications shall be received at the department’s wildlife division in the headquarters office in Concord between the first business day in January and the third Friday in January at 4:00 p.m. or postmarked by the second Friday in January each year;

(3) Any licensed guide who held a bear guide permit for at least 5 of the 13 bear seasons from 2002 to 2014, inclusive, shall be eligible to apply for and obtain a group A bear guide permit;

(4) Any eligible individual shall apply for and obtain a group A bear guide permit each year in order to remain eligible to apply for a group A bear guide permit in subsequent years;

(5) If any eligible individual fails to apply for and obtain a group A bear guide permit, whether because the individual died or for any other reason, that individual shall no longer be automatically eligible for a group A permit;

(6) If any eligible individual fails to apply for and obtain a group A bear guide permit, the group A bear guide permit previously associated with that individual shall be converted into a group B bear guide permit to be issued in accordance with paragraph (h) below, except any newly available group A bear guide permits shall be offered to those individuals on the group A bear guide permit waiting list in the manner described below in subparagraph (7) below;

(7) The group A bear guide permit waiting list shall consist of a list of those individuals who apply for a group B bear guide permit beginning in 2015. The individuals on the list shall be awarded one point for each year they apply for group B bear guide permits. Any group A bear guide permit that is not issued pursuant to subparagraphs (3) through (6) above shall be offered to the individual on the group A bear guide permit waiting list who has the most points. If there are 2 or more individuals with the same high point score, the group A bear guide permit shall be awarded by random drawing of those individuals with the same score. Such drawing shall occur by February 15th of each year; and

(8) The guide’s license referenced in paragraph (a) above shall be issued by the first Monday in February for eligibility for a group A bear guide permit.

(h) The following criteria shall apply to the issuance of group B bear guide permits by the department:

(1) A maximum of X group B bear guide permits shall be issued by the department, where X shall equal 50 minus the number of group A bear guide permits issued that year;

(2) Applications shall be received at the department’s wildlife division in the headquarters office in Concord between the first business day in January and the third Friday in January at 4:00 p.m., or postmarked by the second Friday in January, each year;

(3) If the number of applicants exceeds X, Group B bear guide permits shall be issued by a random drawing of the eligible applications;

(4) The group B bear guide permit drawing shall occur by February 15th of each year; and

(5) The guide’s license referenced in paragraph (a) above shall be issued by the first Monday in February for eligibility for a group B guide permit.

Fis 1102.07 Bear Guide Tags. The “Guided Bear Transportation Tag”, Rev 6/20, shall be completed:

(b) By the guide in Section B and signed subject to the penalties for making unsworn false statements under RSA 641:3.

Fis 1102.08 Moose Lottery Application. Applicants for the moose lottery for moose permits pursuant to Fis 1102.09 shall make application on the “Moose Lottery Application” form provided by the department for the current year’s lottery by supplying the following:

(a) Complete name and mailing address;

(b) Town and state of legal residence at the time of application;

(c) Current driver’s license number or state-issued non-driver identification number and an indication as to whether this number has changed since the applicant last applied;

(d) Date of birth;

(e) Home telephone number and cell or work number;

(f) Moose hunting unit preferences;

(g) Whether he or she is willing to accept an antlerless-only permit; and

(h) Whether he or she wishes to apply for a bonus point only.

Fis 1102.09 Moose Permits.

(a) The fee for a resident moose permit shall be $150.

(b) The fee for a non-resident moose permit shall be $500.

Fis 1102.10 Permit to Place or Use a Blind.

(a) Pursuant to RSA 207:36-a, no person shall erect, build, or use a tree stand or observation blind, or build or use a pit blind, or cut trees in conjunction therewith, upon lands of another person unless express, written permission to take such actions has been procured from the property owner or their designee.

(b) Written permission shall include the name and contact information of the landowner and at least the name of the permittee.

(c) The permittee shall carry the written permission document, in hardcopy or electronically, on their person while on the land of another, and the document shall be subject to inspection upon the request of any conservation officer or law enforcement officer.

Fis 1102.11 Landowner Permit for Coyote Hunting at Night.

(a) Properly licensed hunters may hunt coyote at night on lands other than their own after obtaining written permission from the landowner or occupant of the land where the hunting shall be done.

(b) Blank “Coyote Night Hunting Landowner Permit” forms may be obtained from the fish and game department.

(1) Name and address of the permittee;

(2) Name and address of the landowner or occupant;

(3) Town and location of the land being hunted upon;

(4) Date issued by the landowner or occupant;

(5) Signature of the landowner or occupant; and

(6) The hours that coyote can be hunted at night, specified by the landowner.

(d) Permits shall be in duplicate with the original mailed to the conservation officer assigned the town where the hunting for coyote at night is to be done. The copy shall be retained on the hunter’s person while hunting coyote at night.

Fis 1102.12 Use of Dogs to Take Bear.

(a) Applicants for a permit to use dogs to take bear shall provide on a form provided by the department:

(1) Name and address of applicant;

(2) New Hampshire hunting license number and bear permit number;

(3) Telephone number of applicant;

(4) Date of birth of applicant;

(5) Date of permit;

(6) The individual frequency of each radio collar to be utilized while taking bear, if applicable; and

(7) Signature of applicant, signed subject to the penalties for making unsworn false statements under RSA 641:3.

(b) Prior to hunting, the permittee shall distribute the copies of the permit as follows:

(1) One copy shall be retained on the permittee while hunting bear with dogs; and

(2) One copy shall be submitted to the N.H Fish and Game Department, Wildlife Division, 11 Hazen Drive, Concord, NH 03301.

(c) The permit to take bear with dogs shall become effective when one copy is presented in hand or postmarked and mailed in an envelope addressed to the N.H. Fish and Game Department, Wildlife Division, 11 Hazen Drive Concord, NH 03301, prior to the taking of a bear.

(d) A permit to take bear with dogs shall be valid for a single permittee only and have only the permittee’s name entered on the permit.

(e) The hunter’s copy of the permit to take bear with dogs shall be presented to a conservation officer, bear registration agent, or designee, at the time of tagging.

(f) A permit to take bear with dogs shall expire at the end of the dog hunting season for bear, as specified in Fis 301.06(e), in the year for which the permit was issued.

PART Fis 1103 TRAPPING AND FUR LICENSES AND PERMITS

Fis 1103.01 Trapping Licenses.

(a) An applicant for any of the following trapping license types shall complete and submit an “Application for Trapping License” form, Rev 7/25, available at https://www.wildlife.nh.gov/sites/g/files/ehbemt746/files/documents/trapping-license.pdf,

pursuant to Table 1100.08 below, together with the required fee determined in accordance with Fis 1110.01 and Fis 1110.02:

(b) Pursuant to RSA 214:11-a, every applicant age 16 and older shall also provide a copy of their current state issued motor vehicle driver license or state issued non-driver photo identification card which shall be used to determine if the applicant qualifies for status as a resident of New Hampshire.

(c) Resident minors shall provide a copy of their parent or legal guardian’s current state issued motor vehicle driver license or state issued non-driver photo identification card which shall be used to determine if the applicant qualifies for status as a resident of New Hampshire pursuant to RSA 214:11-a.

(d) Pursuant to RSA 210:25 and RSA 214:11-b, every applicant for a trapping license shall also present written proof of completion of a trapper education course from this or any other state or Canadian province, or a previously held trapping license issued by this state within the previous 3 years, in accordance with Fis 1109.13.

(e) All types of trapping licenses shall be effective between July 1 of the year of issue and June 30 of the subsequent year.

(f) No existing trapping license shall be renewed before June 1 of the current year or until a report of furs and skins taken required by Fis 303.08 has been filed by the licensed trapper.

Fis 1103.02 Fur Buyer’s License.

(a) An applicant for a fur buyer’s license shall complete and submit an “Application for Fur Buyer’s License” form, Rev 7/25, available at https://www.wildlife.nh.gov/sites/g/files/ehbemt746/files/documents/fur-buyers.pdf, together with the required fee as determined in accordance with Fis 1110.08.

(b) Every applicant shall also provide a copy of their current state issued motor vehicle driver license or state issued non-driver photo identification card which shall be used to determine if the applicant qualifies for status as a resident of New Hampshire pursuant to RSA 214:11-a.

(1) Keep a record, open to the conservation officers of the department, of all furs, excluding deer hides, bought and sold;

(2) Report to the department, within 30 days of the expiration of the license, the total number of each kind of fur, excluding deer hides, bought and the average value of each fur;

(3) Cooperate with the conservation officers of the department in all matters pertaining to the fur laws; and

(4) Not buy furs illegally taken to the best of the applicant’s knowledge.

(d) All types of fur buyer’s licenses shall be effective between July 1 of the year of issue and June 30 of the subsequent year.

(e) No existing fur buyers license shall be renewed before June 1 of the current year or until a report of furs bought has been filed by the licensed fur buyer.

(f) The applicant shall only obtain the license in person or by mail from the fish and game department at 11 Hazen Drive, Concord, NH 03301. If submitted to the department by mail, the applicant shall also enclose a business sized, stamped, self-addressed envelope to allow return of the license document by mail.

Fis 1103.03 Permit to Trap.

(a) No licensed trapper shall trap furbearing animals, including beaver and otter by snare, on lands, other than their own, before obtaining written permission to do so, from the landowner or occupant of the land where traps will be set, on a “Permit to Trap” form, Rev 5/05.

(b) A blank “Permit to Trap” form, Rev 5/05 shall be obtained from department headquarters, a conservation officer, or downloaded from the department’s website at trapping-permit.pdf (nh.gov). One copy of the permit shall be returned to a conservation officer when completed.

(d) A permit to trap shall be valid for one licensed trapper only and shall have only one licensed trapper’s name entered on the permit.

(e) All written permissions for trapping on lands other than the licensed trapper’s own land or state managed lands shall expire June 30^th following the date of issuance.

PART Fis 1104 FISHING LICENSES AND PERMITS

Fis 1104.01 Special License for Persons Over 65 on Public Aid.

(a) An applicant for a special public aid fishing license who is aged 65 or older on the date of application shall complete and submit an “Application for Fishing License-Aged Persons” form, Rev 10/18, to the fish and game department at 11 Hazen Drive, Concord, NH 03301.

(c) Every applicant shall provide a copy of a determination letter showing the letterhead of a federal governmental entity, New Hampshire state agency, or local public entity that is providing aid to that applicant to document the type of aid that is being received.

(d) The following types of income shall not qualify as public aid for the purpose of this license:

(1) Payments from the Social Security Administration for post-retirement benefits or Part A, B, or D medicare services;

(2) Retirement benefits from any public or private pension plan, including the NH retirement system;

(3) Any public or private deferred compensation plan, simplified employee pension plan, insurance annuity, or individual retirement arrangement, whether in the form of benefits or payments from an annuity; or

(4) Payments from the United States Department of Veterans Affairs.

(e) The special public aid license shall expire on December 31 of the year of issue.

Fis 1104.02 Special Fishing License for Blind Persons.

(a) An applicant for a special complimentary fishing license to be issued to a legally blind New Hampshire resident shall complete and submit a “Blind Fishing License Application” form, Rev 1/2023, available at blind-fishing-license.pdf (nh.gov), to the fish and game department at 11 Hazen Drive, Concord, NH 03301.

(b) Each applicant shall also submit a determination letter from the department of education, division of career technology and adult learning, bureau of vocational rehabilitation certifying that the person is a legally blind New Hampshire resident.

(c) Each applicant shall also provide a copy of a New Hampshire non-driver photo identification card which shall be used to determine if the applicant qualifies for status as a resident of New Hampshire pursuant to RSA 214:11-a.

(d) On the form required by paragraph (a) above, the applicant shall make the following affirmation, “I certify that I am a resident of the State of New Hampshire as defined in RSA 207:1, XXIII, and that I do not claim residence in any other state for any purpose.”

(e) The license issued hereunder shall be effective so long as the licensee remains a resident of New Hampshire as defined in RSA 207:1, XXIII.

Fis 1104.03 Summer Camp or Educational Facility Group Fishing Application and License.

(a) For the purposes of this rule, an organization shall be treated as a recognized summer camp or educational facility if:

(1) The organization is physically operating from a location within the state of New Hampshire, and is actively engaged in the education of youth;

(2) A minimum of 3 students or campers, all of whom are under the age of 20 years, are actively enrolled in the camping or educational program of the organization; and

(3) The organization’s educational goals and objectives for students or campers are accomplished in whole or in part by the issuance and use of a group fishing license.

(b) Any recognized summer camp or educational facility wishing to obtain a group fishing license in accordance with RSA 214:9, XIII shall complete and submit an “Application for Summer Camp/Education Facility Group Fishing License” form, Rev 10/2018, available at Application for Summer Camp/Education Facility (nh.gov), to the fish and game department at 11 Hazen Drive, Concord, NH 03301, together with the required fee as determined in accordance with Fis 1110.08.

(c) When youth are fishing under the group fishing license, they shall be accompanied by an adult at least 20 years of age, who:

(1) Holds a valid New Hampshire fishing license;

(2) Has the authority to use the group license granted to the applicant organization; and

(3) Is supervising the fishing activities of no more than 10 students at any one time.

(d) Nothing in the group license shall excuse individual compliance with any applicable fish and game rules or regulations.

Fis 1104.04 Bait Dealer’s License.

(a) All applicants for an annual wholesale or retail bait dealer’s license under RSA 214:34 shall complete and submit the “Bait Dealer’s License Application” form, Rev. 01/23, available at bait-dealer.pdf (nh.gov) to the fish and game department at 11 Hazen Drive, Concord, NH 03301.

(b) An applicant desiring to take, purchase from, or sell to another licensed bait dealer, sell to the public, or import up to 100 quarts per day of bait or possess up to 200 quarts per day of bait shall, pursuant to RSA 214:35, seek a wholesale bait dealer’s license.

(c) An applicant desiring to take, sell to the public, purchase, or import up to 20 quarts per day of bait or possess up to 100 quarts per day of bait shall, pursuant to RSA 214:35, seek a retail bait dealer’s license[~~; and~~].

(d) The applicant shall attach to the application the fees as set forth in Fis 1110.05 and a stamped, self-addressed, 4 inch by 9 1/2 inch envelope.

(e) All bait dealer licenses shall expire on December 31 of the year noted on the license.

(f) No bait dealer license shall be issued to an applicant if:

(1) That person as a holder of a license for a previous year has failed to file all of the reports required by Fis 502.08;

(2) The applicant has failed to pay the required fee; or

(3) The applicant’s bait dealer license is under suspension or revocation in accordance with Fis 502.09.

(g) No holder of a bait dealer license shall import fish for bait unless the holder has also been granted a permit to import bait fish in accordance with Fis 1104.07.

Fis 1104.05 Fishing Tournament Permit.

(a) Effective January 1, 2026, an applicant for a fishing tournament shall complete the on-line form “Application for Permit to Conduct a Fishing Tournament”, Rev. 01/26, available at https://www.wildlife.nh.gov/fishing-new-hampshire/tournaments, and submit the required fee, in accordance with Fis 1110.05. If payment of the fee is not received within 10 days of the date of the notice of approval, the application(s) shall be denied for non-payment.

Fis 1104.06 Complimentary Fishing Permits.

(a) The administrator of a New Hampshire state or county institution, nursing home facility, or veteran’s hospital shall apply in writing to the executive director of the department for the issuance of a complimentary group fishing permit to benefit the residents or patients of his or her facility.

(b) The applicant shall include:

(1) The name and address of the facility;

(2) The name and telephone number of a contact person at the facility; and

(3) The number of patients or residents to be included under this permit.

(c) The executive director shall review the request and shall issue the complimentary group fishing permit to the facility under the following conditions:

(1) The complimentary group fishing permit issued to the facility shall be permanent;

(2) The patient or resident fishing under the permit shall be under direct supervision of a staff member or volunteer at all times while fishing;

(3) The person supervising the patient or resident shall not assist in the taking of fish unless the person possesses a fishing license as required by RSA 214:1; and

(4) The permit shall be returned to the department if the facility ceases operation, is no longer a publicly owned facility, or voluntarily ceases to offer fishing as an activity to its patients or residents.

(d) An application to grant a complimentary fishing permit to an individual resident of a head injury treatment facility licensed by the department of health and human services or an individual developmentally disabled person, as defined in RSA 171-A:2, V, shall be filed on the “Complimentary Fishing Permit Application”, form Rev. 01/23, available at complimentary-fishing-permit.pdf (nh.gov), by:

(1) The individual receiving services, if legally capable of filing an application;

(2) The administrator of a head injury treatment facility, on behalf of a patient receiving treatment; or

(3) The parent or legal guardian of a developmentally disabled person.

(e) The applicant, administrator, parent, or guardian shall complete the top portion of form required by paragraph (d) above.

(f) The applicant, administrator, parent, or guardian shall have the bottom portion of the form completed by a physician or advanced practice registered nurse practitioner familiar with the medical condition of the person receiving services.

(g) When both portions of the form have been fully completed, the applicant shall submit it in person or by mail to the fish and game department, 11 Hazen Drive, Concord, NH 03301. If submitted to the department by mail, the applicant shall also enclose a business sized, stamped, self-addressed envelope to allow return of the license document by mail.

(h) Upon verification that the person receiving services is medically eligible as a head injury patient or as a developmentally disabled person, a complimentary permit shall be issued under the following conditions:

(1) The complimentary fishing permit shall be issued in the name of a specific patient, resident, or developmentally disabled person and shall be renewable annually while the person continues to receive services at the facility;

(2) The patient, resident, or developmentally disabled person shall be under direct supervision of an adult person at all times while fishing;

(3) The person supervising the patient, resident, or developmentally disabled person shall not assist in the taking of fish unless the person possesses a fishing license as required by RSA 214:1; and

(4) The permit shall be returned to the department within 10 days if the facility ceases operation, is no longer providing head injury treatment services under its facility license, ceases to offer fishing as an activity to the named patient or resident, or the developmentally disabled person ceases to have fishing as an activity.

Fis 1104.07 Importing Bait Fish.

(a) Applicants for an annual permit to import bait fish shall complete and submit a “N.H. Fish and Game Department Application to Import Fin Fish for Bait” form, Rev. 12/2022, available at import-bait-fish.pdf (nh.gov), to the fish and game department at 11 Hazen Drive, Concord, NH 03301.

(b) All permits to import bait fish shall expire on December 31 of the year noted on the permit.

(1) That person, as a holder of a permit for a previous year, has failed to file all of the reports required by Fis 502.08;

(2) The applicant has failed to pay the required fee;

(3) The applicant does not already possess a valid annual New Hampshire bait dealer license; or

(4) The applicant’s bait dealer license is under suspension or revocation in accordance with Fis 502.09.

PART Fis 1105 MARINE LICENSES AND PERMITS

Fis 1105.01 Commercial Saltwater Licenses.

(a) An applicant for a commercial saltwater and helpers license to take, possess, land, or transport marine species for the purpose of sale shall complete and submit the “Application for Commercial Saltwater Licenses” form, Rev 05/22, available at marine-commercial-salt.pdf (nh.gov), to the fish and game department at 11 Hazen Drive, Concord, NH 03301.

(b) Every applicant shall also provide:

(1) A copy of his or her current state issued motor vehicle driver license or state issued non-driver photo identification card which shall be used to determine if the applicant qualifies for status as a resident of New Hampshire pursuant to RSA 214:11-a;

(2) A fee as determined in accordance with Fis 1110.09; and

(3) A copy of his or her current commercial boat registration document.

(2) If a New Hampshire resident, “I hereby certify that I am a resident of the State of New Hampshire as defined in RSA 207:1, XXIII, and that I do not claim residence in any other state for any purpose.”

(d) The applicant shall only acquire the license in person, by mail from the department at 11 Hazen Drive, Concord, N.H. 03301, or downloaded from the department’s website. If submitted to the department by mail, the applicant shall also enclose a business sized, stamped, self-addressed envelope to allow return of the license document by mail.

(b) Every applicant shall also provide:

Fis 1105.03 Lobster Licenses - Under 5 Pot, Part-Time Commercial and Limited Commercial Lobster and Crab Licenses.

(a) An applicant for the resident special lobster and crab license to use not more than 5 traps under RSA 211:18, commercial, limited commercial, and part-time commercial lobster and crab licenses under RSA 211:18, and lobster helper’s license under RSA 211:20 shall make application on a form in addition to the information required by RSA 214:8, that includes:

(1) The applicant’s:

a. Name and maiden name if applicable;

b. Street and mailing address, if different;

c. Height and weight;

d. Hair and eye color;

e. Date of birth;

f. Home or personal cell phone number; and

g. E-mail address.

(2) If the applicant is not the vessel owner, the following vessel owner information:

a. Name and address; and

b. Home or personal cell phone number;

(3) The following vessel information:

a. Vessel name;

b. State of registration;

c. State registration number or coast guard number;

d. National Marine Fisheries Service federal permit number, if applicable;

e. Principal port;

f. Hull ID number;

g Hull construction material;

h. Vessel length;

i. Year built;

j. Gross and net tons, if federally documented vessel;

k. Horsepower, if federally documented vessel; and

l. Hold capacity in tons, if federally documented vessel;

(4) Crew size, if applicable;

(5) The markings of buoys and on boat that includes:

a. The barrel and spindle color; and

b. The description of buoys; and

(6) An indication of whether or not the applicant held a license the previous year.

Fis 1105.04 Resident or Nonresident Wholesale Marine Species License.

(a) An applicant for a license to buy, sell, process, or transport marine species for the purpose of sale shall complete and submit the “New Hampshire Wholesale Marine Species License Application” form, Rev 05/22, available at marine-wholesale-marine-species.pdf (nh.gov), to the department.

(b) Every applicant shall also provide:

(1) If a person, a copy of his or her current state issued motor vehicle driver license or state issued non-driver photo identification card which shall be used to determine if the applicant qualifies for status as a resident of New Hampshire pursuant to RSA 214:11-a;

(2) If not a person, a copy of a billing or tax document showing the applicant’s actual physical location where business is conducted; and

(3) A fee as determined in accordance with Fis 1110.09.

(d) The license shall expire on December 31 of the year of issue.

Fis 1105.05 Lobster, Lobster Meat, and Crab Dealer Licenses.

(a) Applicants for lobster meat, lobster and crab retail licenses under RSA 211:38 and 211:39 shall make application on a form which shall include, in addition to the information required by RSA 214:8 the following:

(1) The following business information, if license is for a business:

a. Name;

b. Street and mailing address of business;

b. Federal tax ID#;

c. Date of incorporation;

d. Type of business, such as individual or corporation;

e. Business telephone number and individual store telephone number;

f. Name and maiden name, if applicable, of business owner or person responsible for the business;

g. Name of contact person at the individual store; and

h. E-mail address.

(2) If the license is for an individual, the applicant’s:

a. Name and maiden name, if applicable;

b. Street and mailing address;

c. Date of birth;

d. Home or personal cellphone number;

e. Height and weight;

f. Eye and hair color; and

g. E-mail address.

(3) The following information on any vehicle(s) used in the retail business:

a. Make and model;

b. Year;

c. State; and

d. Registration; and

(4) The signature of applicant subject to the penalties for making unsworn false statements under RSA 641:3.

Fis 1105.06 Landing License for Lobster and Crabs.

(a) Applicants for a resident or nonresident landing license under RSA 211:49-d shall provide the following on an application form, in addition to the information required by RSA 214:8:

(1) The applicant’s:

a. Name, and maiden name, if applicable;

b. Street and mailing address, if different;

c. Height and weight;

d. Hair and eye color;

e. Date of birth;

f. Home or personal cell phone number; and

g. E-mail address.

(2) If the applicant is not the vessel owner, the following vessel owner information:

(3) The following vessel information:

a. Vessel name;

Fis 1105.07 Saltwater For-Hire Vessel License.

(a) An applicant for a license to provide recreational saltwater fishing opportunities for persons taking finfish from coastal or estuarine waters shall complete and submit the “Application for Saltwater Fishing Vessels” form, Rev 05/22, available at marine-saltwater-fishing-vessels-app.pdf (nh.gov), to the department.

(b) Every applicant shall also provide:

(1) A copy of his or her current state issued boat registration; and

(2) A fee as determined in accordance with Fis 1110.09.

(c) On the form required by (a) above, each applicant shall make the following affirmation pursuant to RSA 214:18-b: “I certify that my privileges to fish, hunt, trap, guide, take lobsters, or engage in commercial marine fishing activities are not under suspension or revocation in any state or province, and further certify that I am aware that any conviction of certain felonies in any state or province prohibits the possession of a firearm or other dangerous weapon.”

(d) The license shall expire on December 31 of the year of issue.

Fis 1105.08 Commercial Shrimp License.

(a) Applicants for a resident or nonresident commercial shrimp license under RSA 211:49-e shall make application on a form provided by the department.

k. Hold capacity in tons, if federally documented vessel;

(4) Crew size, if applicable;

(5) The type of gear; and

(6) The signature of applicant subject to the penalties for making unsworn false statements under RSA 641:3.

PART Fis 1106 SPECIAL PURPOSES

Fis 1106.01 Scientific Licenses.

(a) An applicant for a license to take wildlife for scientific, research, or educational purposes shall complete and submit an “Application for Scientific License” form, Rev 04/2019 to the department, together with the fee of $25.00, or a request for waiver of the fee in accordance with RSA 214:29.

(b) The licensee shall submit a report of study results by January 31 of the year following issuance of the license for the period covered by the scientific permit, either on the reverse side of the application form noted above, or in a separate written report, to include the following:

(1) The name and address to which the scientific permit was issued;

(2) The purpose and objective of the study;

(3) Species and number wildlife taken;

(4) Age and sex, if known, of wildlife taken;

(5) Location(s) where species were taken or collected, including a map for those wildlife species tracked under this license;

(6) Date received or collected;

(7) Disposition of the wildlife; and

(8) Location where specimens are held, if applicable.

(c) Copies of the permit shall be carried by permittee or subpermittees while engaged in the activities permitted under the scientific license.

(d) Complete reports for previous scientific licenses shall be received before subsequent or renewal applications will be considered.

(e) Waivers of the fee specified in RSA 214:29 shall only be granted to educational and nonprofit institutions and governmental agencies.

Fis 1106.02 Taxidermy License.

(a) An applicant for a license to conduct taxidermy shall complete and submit the “Taxidermy Report and Application” form, Rev 01/23, available at taxidermy-report.pdf (nh.gov), together with a fee as determined in accordance with Fis 1110.08, to the department.

(b) Complete reports for previous taxidermy licenses shall be received before subsequent or renewal applications will be considered.

(c) The applicant shall only acquire the license in person, by mail from the department at 11 Hazen Drive, Concord, N.H. 03301, or downloaded from the department’s website. If submitted to the department by mail, the applicant shall also enclose a business sized, stamped, self-addressed envelope to allow return of the license document by mail.

Fis 1106.04 Wholesale Venison License.

(a) A resident applicant for a license to sell venison on a wholesale basis shall complete and submit an “Application for Wholesale Venison License” form, Rev 10/2018, available at wholesale-venison.pdf (nh.gov) to the department, together with the fee as determined in accordance with Fis 1110.08.

(b) The applicant shall also provide:

(2) If not a person, a copy of a billing or tax document showing the applicant’s actual physical location in New Hampshire where business is conducted.

(c) This license shall be available only in person, by mail from the department at 11 Hazen Drive, Concord, N.H. 03301, or downloaded from the department’s website. If submitted to department headquarters by mail, the applicant shall also enclose a business sized, stamped, self-addressed envelope to allow return of the license document by mail.

Fis 1106.05 Training Dogs. Applicants for a permit to train dogs under RSA 207:12-a shall complete the “Application for Permit to Train Dogs” form by providing the following:

(a) The name, address, and telephone number of the applicant;

(b) Applicants date of birth;

(c) The number and breed of dogs to be trained, the current and valid dog license numbers or the kennel license number, and the name of the town where licensed;

(d) The species of animal or bird which will be utilized for the training of the dogs;

(e) The time of day and day of the week proposed for such training;

(f) The type and number of the hunting license held by the applicant;

(g) The individual frequencies to be utilized while training;

(h) Current New Hampshire hunting license number and type; and

(i) The applicant’s signature, signed subject to the penalties for making unsworn false statements under RSA 641:3.

Fis 1106.07 Voluntary Hike Safe Card.

(a) Individuals seeking to purchase or renew a voluntary hike safe card, as provided in RSA 206:26-bb, I, shall submit the following information to the department through the department’s internet site at https://www.wildlife.nh.gov/get-outside/hiking-safety:

(1) Purchaser’s complete name and email address;

(2) Hike safe cardholder’s name, street address, and date of birth;

(3) Purchaser’s credit card information to include the card type, card number, expiration date, CVV2 code, and a confirmation of the card holder’s information;

(4) Whether the purchaser is purchasing an individual card or a family card; and

(5) For family cards, the complete name and date of birth for each family member.

(b) For purposes of purchasing a family card, families shall include the hike safe cardholder, the purchaser’s spouse or domestic partner, as described in RSA 206:26-bb(c), the minor children and minor stepchildren of the purchaser, and the minor children and minor stepchildren of the purchaser’s domestic partner, as of the date of purchase.

(d) The voluntary hike safe card shall be issued electronically by the department and a confirmation of purchase shall be sent to the email address provided by the purchaser.

(e) The fee for a hike safe card, including a transaction fee, shall be $25 for an individual or $35 for a family per calendar year.

PART Fis 1107 Electronic Issuance OF LICENSES AND PERMITS

Fis 1107.01 Multi-license Form – Electronic Issuance.

(a) The multi-form license described in Fis 1101.01 may be issued electronically by accessing the department online license website at https://www.nhfishandgame.com/.

(b) An applicant shall provide, in addition to the information required by RSA 214:8 and Fis 1101.01, the following:

(1) An email address; and

(2) Credit card information to include:

a. Card type;

b. Card number;

c. Expiration date; and

d. A confirmation of the card holder information.

PART Fis 1108 DUPLICATE LICENSES AND TAGS

Fis1108.01 Duplicate Licenses and Tags.

(a) A reprint of an existing and valid license document issued electronically by the department or its agents pursuant to Fis 1107.01 shall be available at no charge to the purchaser:

(1) On the department online license website;

(2) From the original issuing agent of the lost license if he is able to verify original sale; or

(3) At the fish and game department 11 Hazen Drive, Concord NH 03301.

(b) An applicant who requests issuance of a current and valid duplicate license document that is not issued electronically pursuant to Fis 1107.01 shall complete and submit in person or by mail an “Application for Duplicate License” form, Rev 03/2019, to the department at 11 Hazen Drive, Concord, NH, together with the required fee for each duplicate license document requested.

(c) The required fee of $5.00, in accordance with RSA 214:9-b and the $1.00 agent fee in accordance with RSA 214-A:4 shall be per license form. If submitted to the department by mail, the applicant shall also enclose a business sized, stamped, self-addressed envelope to allow return of the license document by mail.

PART Fis 1109 GENERAL ADMINISTRATION

Fis 1109.01 Federal Duck Stamp.

(a) A reference to the federal duck stamp on any departmental form shall provide the form user the ability to purchase through the department a federal “Migratory Bird Hunting and Conservation Stamp” issued by the U.S. Fish and Wildlife Service. This ability shall be offered as a convenience to the form user.

(b) Nothing herein shall excuse any person from compliance with the requirements of RSA 209:6 to obtain and have on his or her person an unexpired federal duck stamp when engaged in activities controlled by the Migratory Bird Treaty Act of 1918, 16 U.S.C. 703-712, and regulations found at 50 C.F.R. Part 10 and Part 21.

Fis 1109.02 Forms. Whenever a person is required to complete a written or electronic form, the following shall apply:

(a) Forms shall be filled out completely;

(b) Forms shall be completed in a legible manner; and

Fis 1109.03 Incomplete Form.

(a) All forms shall be reviewed by the department in accordance with RSA 541-A: 29.

(b) The submitting party shall be notified of any apparent errors or omissions and allowed to resubmit the form to the department, provided that this opportunity shall not extend any date or deadline for the submission of information to the department imposed elsewhere in these rules.

Fis 1109.04 Failure to Comply with Statute or Rule.

(a) In the event an applicant fails to comply with an applicable statute or rule, the application shall not be processed.

(b) The applicant shall be notified of the reason(s) for the rejection orally if presenting the application in person or by mail if the application has been received in the mail.

(d) If the applicant contests the reason for rejection, the applicant may seek a hearing in accordance with the procedures contained in Fis 200.

Fis 1109.05 Fees, Form of Payment. Whenever an applicant makes payment to the department for satisfaction of a fee, the following shall apply:

(a) Payment shall be made in the form of cash, check, money order, or accepted credit cards;

(b) Checks and money orders shall be made payable to the department or the “State of New Hampshire”. Alternative payees, including but not limited to “State of New Hampshire Fish and Game,” “New Hampshire Department of Fish and Game,” or “Treasurer - State of New Hampshire,” shall be accepted, provided the payee name does not lend itself to endorsement by any party other than the State of New Hampshire, and;

(c) Unless otherwise provided in these rules, any fee prescribed by statute or rule shall be submitted in full at the same time as the application. No required fee shall be pro-rated to a smaller amount based upon the number of days that the license will be effective; and

(d) Unless otherwise provided in these rules, no agent shall be authorized to refund, adjust, or modify any license fee once paid by the applicant.

Fis 1109.06 Checks.

(a) Post-dated checks shall not be accepted.

(b) Checks shall be for the exact amount due to the department.

(d) No check shall be accepted which is dated more than 90 days prior to receipt.

(e) In the event a non-compliant check is presented for payment, the application for a license or permit shall be rejected, and the applicant shall be notified in accordance with Fis 1109.04.

Fis 1109.07 Legal Address. Whenever an applicant is required to furnish his or her address by statute or rule, the address shall reflect a street, road, avenue, or like designation. A post office or rural route box number, without more, shall not be adequate.

Fis 1109.08 Application via the U.S. Mail.

(a) An applicant may choose to file an application via the U.S. Mail with the department at 11 Hazen Drive, Concord, NH 03301.

(b) The burden shall be upon the applicant to mail such application sufficiently in advance to leave 5 business days for processing by the department.

(c) When so noted on an application form, the applicant shall include a stamped self-addressed envelope with the application in order to permit the requested license to be mailed to the applicant once issued.

(d) No agent of the department shall be authorized to process any application described in these rules received by the agent via the U.S. Mail.

Fis 1109.09 Transfer of License or Permit Prohibited. No license or permit issued in accordance with sections Fis 1100 through Fis 1108 shall be transferable to another person or entity.

Fis 1109.10 Complaints and Hearing. Complaints shall be received and administrative hearings shall be conducted in accordance with the procedures set forth in RSA 541-A: 29, Fis 200, and Fis 1800.

Fis 1109.11 Validity of License.

(a) No license issued by the department in paper format pursuant to this chapter shall be treated as valid until the document has been signed in ink by the licensee.

(b) A fishing license issued in electronic format shall be treated as valid if displayed through the email account to which it was issued, even in the absence of the signature of the licensee.

(c) Unless stated otherwise in statute or these rules, all licenses issued by the department shall expire on December 31 of the year of issue.

Fis 1109.12 Residency in New Hampshire.

(a) Pursuant to RSA 214:11-a, residency in New Hampshire shall be verified by inspection of a valid New Hampshire driver’s license or New Hampshire nondriver’s picture identification card issued by the New Hampshire department of safety.

(b) Except as otherwise provided by statute, no other documents purporting to show the residential address of the applicant shall be accepted for the purpose of issuing a license under these rules.

Fis 1109.13 Recognition of Completion of Required Education Courses.

(a) Pursuant to RSA 214:23-a, no firearm hunting or archery license shall be issued to or be purchased by any person unless the applicant presents to the department or its agent:

(1) A certificate of completion of the basic hunter education program offered by the department;

(2) A certificate of completion of the basic hunter and archery education program or basic archery hunting program offered in any other state, province, or country, provided that such program includes live field instruction in the handling of firearms or the handling of archery equipment. An “online only” type of educational program shall not be recognized as meeting this requirement; or

(3) Documentary proof that the applicant previously held a firearm hunting license or archery license issued by another state, province or country in the form of:

a. The actual license document issued to the applicant; or

b. A statement in writing issued by the previous licensing authority showing the type of license(s) issued, and the dates that such licenses were held by the applicant.

(b) Pursuant to RSA 214:11-b, no trapping license shall be issued to or be purchased by any person unless the applicant presents to the department or its agent:

(1) A certificate of completion of the trapper education program offered by the department;

(2) A certificate of completion of the trapper education program offered in any other state, province, or country, provided that such program includes live field instruction in the handling of trapping equipment. An “online only” type of educational program shall not be recognized as meeting this requirement; or

(3) Documentary proof that the applicant previously held a trapping license in this state during any of the 3 years prior to application for this license.

Fis 1109.14 Release of Information Contained in Licenses, Permits, and Application Forms. Unless specifically required by a court order, RSA 91-A, or the constitution of the State of New Hampshire, all information provided to the department by an applicant under these rules that would tend to identify a person’s name, a physical or mailing address, an electronic mail address, or the licensing status of the applicant in this or any other state or province shall be treated as confidential and not subject to disclosure.

(a) The fee for a resident hunting license, pursuant to RSA 214:9, I, shall be $31.

(b) The fee for a resident fishing license, pursuant to RSA 214:9, II, shall be $43.

(e) The fee for a resident trapping license, pursuant to RSA 214:9, IV, shall be $35.

Fis 1110.05 Freshwater Fishing Miscellaneous Permits and Licenses.

(a) The fee for a permit to promote or operate a fishing tournament, pursuant to RSA 211:16-b, shall be $49, except as set forth in (b) and (c), below.

(b) The fee for a catch, measure, and release bass fishing tournament permit shall be $10.

(d) There shall be no fee for any New Hampshire Interscholastic Athletic Association (NHIAA) bass fishing tournaments.

(e) The fee for a license to sell freshwater fishing bait, pursuant to RSA 214:34, II and III, shall be:

(1) Twenty-five dollars in addition to the agent fee for retailers required by RSA 214-A:4, I; and

(2) Seventy-five dollars in addition to the agent fee for wholesalers required by RSA 214-A:4, I.

Fis 1110.07 Persons Over 68 Years of Age.

(a) There shall be no fee for the special annual license to trap, pursuant to RSA 214:7-a, I, for those residents over age 68. This license shall be issued only at Fish and Game Headquarters or by mail.

(b) There shall be a $5 annual fee, in addition to the applicable habitat fees, agent fee, and transaction fee, for the special annual combination license to hunt and fish in freshwaters, pursuant to RSA 214:7-a, I, for those residents over age 68.

(c) There shall be a $5 annual fee, in addition to the applicable habitat fee, agent fee, and transaction fee, for the special annual license to fish in freshwaters, pursuant to RSA 214:7-a, I, for those residents over age 68.

(d) There shall be a $2 annual fee, in addition to the applicable habitat fee, agent fee, and transaction fee, for each of the following special annual licenses, pursuant to RSA 214:7-a, I, for those residents over age 68:

(1) Archery; and

(2) Muzzleloader.

Fis 1110.08 Miscellaneous Fees.

(a) The fee for a permit to train dogs, pursuant to RSA 207:12-a, shall be $5.

Fis 1110.09 Marine Permit Fees.

(a) The fee for a license to take lobsters and crabs, pursuant to RSA 211:18, shall be as follows, plus a surcharge in the amount of $15 for each license purchased, to be placed into the derelict fishing gear and coastal cleanup fund, established by RSA 211:77, unless exempted in accordance with RSA 211:18, III-c:

(1) Three hundred fifty dollars for a resident commercial lobster and crab license;

(2) Six hundred dollars for a nonresident commercial lobster and crab license;

(3) Two hundred dollars for a resident limited commercial lobster and crab license;

(4) Four hundred dollars for a nonresident limited commercial lobster and crab license;

(5) One hundred twenty-five dollars for a resident part-time commercial lobster and crab license;

(6) Three hundred fifty dollars for a nonresident part-time commercial lobster and crab license; and

(7) Forty dollars for a recreational lobster and crab license.

(b) The fee for a lobster helper’s license, pursuant to RSA 211:20, shall be $20.

(c) The fee for a lobster or crab retail dealer license, pursuant to RSA 211:39, shall be $50 for residents and $75 for nonresidents.

(d) The fee for a nonresident commercial saltwater license, pursuant to RSA 211:49-a, II, shall be $500 plus a surcharge in the amount of $15 for each license purchased, to be placed into the derelict fishing gear and coastal cleanup fund, established by RSA 211:77, unless exempted in accordance with RSA 211:49-a, II.

(e) The fee for a resident commercial saltwater license, pursuant to RSA 211:49-b, II, shall be $50 plus a surcharge in the amount of $15 for each license purchased, to be placed into the derelict fishing gear and coastal cleanup fund, established by RSA 211:77, unless exempted in accordance with RSA 211:49-b, II.

(f) The fee for a nonresident marine wholesaler license, pursuant to RSA 211:49-aa, I, shall be $260, and the fee for each extra facility license shall be $100.

(g) The fee for a resident marine wholesaler license, pursuant to RSA 211:49-c, I, shall be $130, and the fee for each extra facility license shall be $75.

(h) The fee for a lobster and crab landing license, pursuant to RSA 211:49-d, shall be $50 for residents and $500 for nonresidents.

(i) The fee for a commercial shrimp license, pursuant to RSA 211:49-e, II and III, shall be $100 for residents and $500 for nonresidents.

(j) The fee for a resident oyster license, pursuant to RSA 211:62-a, shall be $29, in addition to the agent fee required by RSA 214-A:4, I.

(k) The fee for a resident recreational clamming license, pursuant to RSA 211:64-b, shall be $29, in addition to the agent fee required by RSA 214-A:4, I.

(l) The fee for a resident commercial clamming license, pursuant to RSA 211:62-d, shall be $300.

(m) The fee for a resident saltwater recreational license, pursuant to RSA 214:9, XVI, shall be $10, in addition to the agent fee required by RSA 214-A:4, I.

(n) The fee for a nonresident saltwater recreational license, pursuant to RSA 214:9, XVI, shall be $10, in addition to the agent fee required by RSA 214-A:4, I.

(o) The fee for each charter boat or other for-hire vessel with 6 or fewer passengers, except party boats, pursuant to RSA 214:9, XVI, shall be $50, in addition to the agent fee required by RSA 214-A:4, I.

(p) The fee for each party boat, pursuant to RSA 214:9, XVI, shall be $100, in addition to the agent fee required by RSA 214-A:4, I.

Fis 1110.10 Exemption from License Surcharge.

(a) A licensee who is subject to a license surcharge pursuant to RSA 211:18, III-b, RSA 211:49-a, II, RSA 211:49-b, II, or RSA 211:62-e, II-b shall be exempted from the annual surcharge if the licensee engages in satisfactory participation in the previous year’s department qualifying coastal cleanup program(s).

(b) For the purpose of this section, “satisfactory participation” means:

(1) Physical presence at a department sponsored or sanctioned coastal cleanup event as documented by sign-in and sign-out sheets maintained by the event sponsor and provided to the department; or

(2) Contribution of cash in an amount equal to or greater than the amount of the license surcharge for deposit into the derelict fishing gear and coastal cleanup fund established in RSA 211:77.

(1) One or more marine coastal cleanup events directly sponsored and administered by the department, as advertised annually on the department website; or

(2) Any marine coastal cleanup event approved by the department and advertised as an approved event on the department website, provided that records of the names and addresses of participating individuals, and the hours of actual participation, are kept and provided to the department within 30 days of the end of the event.
