CHAPTER Puc 100  ORGANIZATIONAL RULES

 

REVISION NOTE 1:

 

          Document #6470, effective 3-18-97, made changes to the wording, format, and numbering of rules in Chapter Puc 100.  Former Part Puc 101, Definitions, was amended and renumbered as Part Puc 102.  Former Part Puc 102, Description and Contact Information for the Commission,  was amended and renumbered as Part Puc 103.  Part Puc 101, and Part Puc 104 are new rules adopted in Document #6470.

 

          Document #6470 supersedes all prior filings for the sections in this chapter.  The prior filings for former Chapter Puc 100 include the following documents:

REVISION NOTE 2:

 

          Document #14185, effective 1-24-25, made extensive changes to chapter Puc 100 by adopting, readopting with amendment, and repealing various sections of the chapter, as well as reorganizing the structure of the chapter.

 

          Document #14185 repealed Puc 101.01, “Applicability”, Puc 102.01 the definition of “adjudicative proceeding”, Puc 102.03 through Puc 102.22 including the definitions of “complaint”, “contested case”, “hearing”, “motion”, “order”, “party”, “petition”, prehearing conference”, prehearing order”, “presiding officer”, “proceeding”, “public statement hearing”, “respondent”, “routine filings”, “rulemaking”, “staff”, and “technical session”. Puc 103.01, “Commission Functions”, was also repealed.

 

          The prior filings for former Puc 100 include the documents above in Revision Note 1 and the following documents:

          As procedural rules the rules in Document #14185 will not expire except pursuant to RSA 541-A:17, II.

 

PART Puc 101  APPLICABILITY

 

          Puc 101.01 “Chairman” means the commission's presiding commissioner and administrative head, who is appointed under RSA 363:4 and possesses the powers and duties conferred under RSA 21-G:9.

          Puc 101.02  “Clerk’s office” means the office designated by the commission to receive all filings and to maintain the commission docket system.

          Puc 101.03  “Commission” means the public utilities commission established under RSA 363:1.

          Puc 101.04  “Commissioner” means a member of the commission appointed under RSA 363:3.

          Puc 101.05 “Customer” means any person, firm, partnership, corporation, cooperative marketing association, tenant, governmental unit, or subdivision of a municipality, or the state of New Hampshire who has contracted for gas, sewer, or water service from a utility.

          Puc 101.06  “Department” means the New Hampshire department of energy.

          Puc 101.07 “Document” means any paper or electronic record, including without limitation, any application, complaint, petition, motion, prepared testimony, date request, data response, exhibit, brief, written communication, or correspondence. With respect to an electronic record, “the term” does not include information that would not appear if the document were printed in paper form.

          Puc 101.08  “Office of the consumer advocate (OCA)” means the office of the consumer advocate established under RSA 363:28.

          Puc 101.09  “Person” means any individual, partnership, corporation, association, governmental subdivision, or public or private organization of any character which appears before the commission for any purpose.

          Puc 101.10  “Service list” means the list of persons entitled to receive notice of all filings and commission orders in a specific commission docket.

PART Puc 102  DESCRIPTION AND CONTACT INFORMATION FOR THE COMMISSION.

 

          Puc 102.01  General Description.

 

          (a)  The commission is an independent state agency comprised of a chairman, 2 commissioners, and staff members who report to the chairman. The commission exercises jurisdiction of matters as outlined in Puc 102.02 and Puc 204.01 and other responsibilities as delegated to it by the General Court.

          Puc 102.02  Jurisdiction.  The commission’s jurisdiction shall include:

 

          (a)  The general supervision of the state’s public utilities as outlined by RSA 374:3;

 

          (b)  Acting as the arbiter between the interests of public utilities and customers; and

 

          (c)  Ensuring that the rates, fares, charges, and prices  to customers are just, reasonable, and lawful.

PART Puc 103  REQUESTS FOR PUBLIC INFORMATION

 

          Puc 103.01  General Inquiries and Requests for Access to Records.

 

          (a) General inquiries about the commission may be transmitted to the clerk’s office at the address and telephone  number specified in Puc 102.03(a).

 

          (b)  Any person requesting access to commission records under RSA 91-A shall direct a request for access as specified in (c) below.

 

          (c)  A request to access commission records shall be in writing, and:

 

(1)  Identify as particularly as possible the information being sought;

 

(2)  Include a statement that the requestor agrees to pay a copying fee equal to the greater of the actual cost of providing the copy or $0.25 per page, or an affirmative request that based on financial hardship the Requestor is asking for a waiver of the fee(s), if applicable; and

 

(3)  Be transmitted to the clerk at the address specified in Puc 102.03(a).
