STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Three

AN ACT permitting certain village districts to become eligible for state highway aid apportionment.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Apportionment. Amend the introductory paragraph and paragraph I of RSA 235:23 to read as follows:

All funds available to cities, towns and unincorporated places, and to village districts eligible under subparagraph I(b), pursuant to the provisions hereof, shall be allotted by the commissioner of transportation upon the following basis:

I. APPORTIONMENT A.

(a) In each fiscal year, the commissioner shall allocate an amount not less than 12 percent of the total road toll revenue and motor vehicle fees collected in the preceding fiscal year to a local highway aid fund. This fund shall be distributed to each city, town, [and] unincorporated place, and eligible village district on a formula in which 1/2 of the amount is based on the proportion which the mileage of regularly maintained class IV and class V highways in each municipality, as of January 1 of the previous year, bears to the total of such mileage in the state; and 1/2 of the amount is based on the proportion which the office of state planning population estimate of each municipality bears to the latest estimate of the total population of the state as of July 1 of the year of the estimate. The aid to be distributed under this [paragraph] subparagraph shall be in addition to all other state and federal aid specifically authorized by statute.

(b) To be eligible for apportionment of highway funds under subparagraph I(a), a village district shall meet the following requirements:

(1) The district shall have been organized pursuant to RSA 52 and shall have included among its purposes the layout, acceptance, construction, and maintenance of roads pursuant to RSA 52:1, I(m) and shall have been in existence for such purpose for a period of not less than 5 years prior to the year in which it seeks to participate in the highway fund allocation.

(2) The district shall have a minimum of 5 miles of class IV or V highways for which it is responsible in the year preceding the allocation and shall have raised and appropriated a sum for highway maintenance, construction, or reconstruction of not less than $30,000 within each of the 5 years preceding the allocation.

(3) The district shall be approved by the commissioner as meeting the requirements of this subparagraph based upon an application filed in accordance with procedures and requirements adopted by rules of the commissioner pursuant to RSA 541-A.

2 Applicability. The highway aid allocation for which a village district may initially be eligible under RSA 235:23 as amended by section 1 of this act shall be the allocation for the fiscal year commencing on July 1, 2003.

3 Repeal. RSA 231:4, relative to village districts being ineligible for road funds, is repealed.

4 Effective Date. This act shall take effect 60 days after its passage.

HB 708 FISCAL NOTE

AN ACT permitting certain village districts to become eligible for state highway aid apportionment.

FISCAL IMPACT:

The Department of Transportation and New Hampshire Municipal Association indicate this bill will have no fiscal impact on state, county and local revenue or expenditures.

METHODOLOGY:

The Department of Transportation and New Hampshire Municipal Association states this bill reallocates state highway aid apportionment funds by reducing funds to municipalities, and increasing those to village districts. In total, state highway aid to local entities will not change, but the allocation among municipalities and village districts will.
