I. Each operator shall register with the department the name and address of each place of business within the state where it operates a hotel, sells taxable meals, [or] rents motor vehicles, or charges admission charges. The operator shall pay $5 for each registration, upon receipt of which the department shall issue a license for each place in such form as it determines, attesting that the registration has been made. The license expires on June 30 in each odd-numbered year unless sooner revoked or suspended by the department. The license shall be conspicuously posted in a public area upon the premises to which it relates.

II. No person shall engage in serving taxable meals, renting rooms, [or] renting motor vehicles, or charging admission charges without first obtaining the license required by this section. The license is nonassignable and cannot be transferred. Any person who fails to register or obtain a license as provided in this section shall be subject to the penalty provisions of RSA 21-J:39.

5 Meals and Rooms Tax; Collection of Taxes. Amend RSA 78-A:7, I to read as follows:

If the tax is included in the price of the meal, occupancy, [or] gross rental receipts received, or admission charges upon request the operator shall state to the purchaser, occupant, [or] renter, or participant the amount of the tax.

6 Meals and Rooms Tax; Collection of Tax. Amend RSA 78-A:7, IV to read as follows:

HB 666 FISCAL NOTE

AN ACT expanding the meals and rooms tax to include a tax on admission charges for entertainment.

FISCAL IMPACT:

The Department of Revenue Administration indicates this bill will increase state unrestricted general fund revenue by $25.3 million in FY 2004 and $26.4 million in FY 2005 and each year thereafter, and increase general fund expenditures by $50,000 in FY 2004. There is no fiscal impact on county and local revenue or state, county and local expenditures.

METHODOLOGY:

The Department of Revenue (DRA) stated that adding amusements as taxable under the meals and rooms tax will increase state revenue by $25.3 million in FY 2004 and $26.4 million in FY 2005. This increase was estimated using the 1997 census bureau economic census and projecting forward using actual meals and rooms tax growth rates for FY 1997 - FY 2002, and projected growth rates for FY 2003 - FY 2005. These growth rates and corresponding tax increases are summarized in the table below. The Department did not project beyond FY 2005, however, the tax will continue until legislatively repealed.

Estimated

Growth Amusement

FY Rate Tax

1997 4.95% $16,400,000

1998 8.16% $17,737,538

1999 6.66% $18,918,772

2000 9.12% $20,644,312

2001 4.96% $21,667,727

2002 7.95% $23,390,923

2003 3.97% $24,319,646

2004 4.00% $25,292,432

2005 4.50% $26,430,592

The Department can administer this tax using current staff, but would need $50,000 in FY 2004 to adapt the current tax collection software to this tax change.
