STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Three
AN ACT relative to incineration and air quality.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Section; Municipal Waste Combustors; Restricted Operation. Amend RSA 125-C by inserting after section 10 the following new section:
125-C:10-a Municipal Waste Combustors; Restricted Operation.
I. A municipal waste combustor with a design capacity to burn 100 tons but not more than 250 tons per day of municipal solid waste shall not be allowed to operate on those days declared as an air quality action day by the department. Such a municipal combustor may resume incineration 24 hours after the air quality action day has been lifted. For the purpose of this section, an "air quality action day" means any day that exceeds, or is anticipated to exceed, federal air quality standards as determined through monitoring by the department.
II. A municipal waste combustor that produces electrical power for resale shall not pass on costs of lost revenue from electrical power sales resulting from such shutdowns.
III. Violations of this section shall be subject to the enforcement provisions of RSA 125-C:15.
2 New Subparagraph; Rulemaking. Amend RSA 125-C:4, I by inserting after subparagraph (n) the following new subparagraph:
(o) Enforcement of restricted burning during air quality action days under RSA 125-C:10-a.
3 Effective Date. This act shall take effect January 1, 2004.
