AN ACT relative to limiting liability of vendors and property owners during the operation of a farmers' market.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraphs; Limited Liability for Farmers' Markets. Amend RSA 508:14 by inserting after paragraph II the following new paragraphs:
III. An owner, occupant, or lessee of land, including the state or any political subdivision, who without charge permits any person or group of persons to use land for the purposes of a farmers' market, as defined in RSA 175:1, XXXI-a, shall not be liable for personal injury or property damage in the absence of intentionally caused injury or damage.
IV. A vendor at a farmers' market, shall not be liable for personal injury or property damage to any person in the absence of willful, wanton, or reckless conduct by such vendor.
2 Effective Date. This act shall take effect January 1, 2004.
