STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Two

AN ACT making appropriations to the department of health and human services.

Be it Enacted by the Senate and House of Representatives in General Court convened:

208:1 Appropriations. The sum of $11,800,000 is hereby appropriated to the department of health and human services for the fiscal year ending June 30, 2002 for purposes of making provider payments and for purposes of making payments for expenses for community health and community mental health centers, and the sum of $3,000,000 is hereby appropriated to the department of health and human services for the fiscal year ending June 30, 2003 for purposes of making payments to the division for children, youth and families for protective services required by the settlement of certain litigation, and for purposes of making payments for expenses for community health and community mental health centers. The governor is authorized to draw a warrant for such sums.

208:2 Funding. The funding source for the appropriation made in section 1 of this act shall be from excess proshare revenue claimed and received by the state in fiscal year 2002 attributable to fiscal year 2000. In the event that the allowability of the excess proshare revenue is still unresolved as of December 1, 2002, the appropriation made in section 1 of this act shall instead become a charge against the health care fund, as established by RSA 167:70.

208:3 Funding. If, as of December 1, 2002, the health care fund is charged in whole or in part with the appropriation made by section 1 of this act, then at such time as the proshare revenue allowability is resolved, the health care fund shall be replenished to the extent that it was used to fund the appropriation. The commissioner of the department of health and human services shall notify the commissioner of the department of administrative services when the final resolution has been arrived at and the commissioner of the department of administrative services shall at that time replenish the fund. The governor is authorized to draw a warrant for such sum, as the commissioner of the department of administrative services requires to satisfy this section.

208:4 Effective Date. This act shall take effect upon its passage.
