HB 392 FISCAL NOTE
AN ACT relative to a property tax exemption for property of agricultural fairs.
FISCAL IMPACT:
The Department of Revenue Administration and the Board of Tax and Land Appeals state this bill, as amended by the House, (House Amendment #2001-1999h), will have no fiscal impact on state, county, and local revenue or expenditures.
METHODOLOGY:
This bill will require charitable agricultural fairs to file, with the municipality in which the property is located, a statement of its financial condition for the preceding fiscal year, and such other information as may be necessary to establish its status and eligibility for a tax exemption. The required filing will have no fiscal impact on state, county, and local revenue or expenditures.
The Department contacted all communities by phone to determine what their local assessments were on fairground property and how much, if any, were currently being exempted under RSA 72:23. Five communities already exempt all fairground property, while three communities exempt a portion of the property and three do not exempt the properties. Fairground property owned by 4-H associations are universally exempted. The Department of Revenue Administration states, if exemptions were granted, they would decrease state education trust fund revenue by $35,335, and decrease local revenue by $86,807 in FY 2002. The effects of exemptions on revenue cannot be determined in FY 2003 and each year thereafter. The Department cannot adequately determine the potential effects of an exemption on county revenue or expenditures at this time.
The Board of Tax and Land Appeals states requiring charitable agricultural fairs to file the RSA 72:23, VI form will require no additional costs to the Board in modifying the form, nor will there be any significant increase in costs to municipalities in receiving such forms as there are only approximately eleven agricultural fairs in the state.
