STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand One

AN ACT relative to titles to destroyed vehicles.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 New Paragraph; Dismantling or Destruction of Vehicle; Certificate of Destruction. Amend RSA 261:22 by inserting after paragraph VI the following new paragraph:

VII. If the estimated costs of repairing the physical and mechanical damage to a vehicle are equal to 90 percent or more of the current retail cost of the vehicle, as established in any official used car guide, the department shall declare the vehicle unrebuildable and print a certificate of destruction, which authorizes the dismantling or destruction of the motor vehicle described therein. The director may charge a fee for a certificate of destruction that is no greater than the fee for a salvage certificate of title. This certificate of destruction shall be reassignable a maximum of 2 times before dismantling or destruction of the vehicle shall be required, and shall accompany the motor vehicle for which it is issued, when such motor vehicle is sold for such purposes, in lieu of a certificate of title, and, thereafter, the department shall refuse issuance of any certificate of title for that vehicle. This paragraph shall not apply when a vehicle is worth less than $1,500 retail in undamaged condition in any official used motor vehicle guide or when a stolen motor vehicle is recovered in substantially intact condition and is readily resalable without extensive repairs to or replacement of the frame or engine.

2 Effective Date. This act shall take effect 60 days after its passage.
