STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand One
AN ACT relative to antique former military vehicles.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subparagraph; Rulemaking; Commissioner of Safety; Antique Former Military Vehicles. Amend RSA 21-P:14, III by inserting after subparagraph (ii) the following new subparagraph:
(jj) Marking of and proof of registration for antique former military vehicles, as authorized by RSA 261:89-d.
2 New Section; Antique Former Military Vehicles. Amend RSA 261 by inserting after section 89-c the following new section:
261:89-d Antique Former Military Vehicles.
I. As used in this section, "antique former military vehicle" means a vehicle which has been, but no longer is, used by the armed forces of a national government and which displays markings indicating it was a military vehicle.
II Except as provided in this section, antique former military vehicles shall be exempt from the registration provisions of this chapter if:
(a) The antique former military vehicle is used only for exhibitions, club activities, parades, and other functions of public interest and will not be used for regular transportation; and
(b) The owner of the former military vehicle files with the director a sworn affidavit, signed by the owner, stating that the vehicle is an antique former military vehicle and will be used exclusively for the purposes permitted in subparagraph (a).
III. It shall be a violation for any person to drive or any owner or custodian to knowingly permit or cause to be driven on the ways of this state any antique former military vehicle unless the same has been registered and the appropriate fee paid in accordance with the provisions of this section. For each antique former military vehicle, the registration fees shall be the same as for an antique motor vehicle. Upon application for registration, the owner shall provide the same information as is required to register an antique motor vehicle.
IV. An antique former military vehicle shall not be required to display a number plate if current proof of registration for the vehicle, in a form prescribed by the director, is carried in the vehicle. The owner shall display in a prominent location on the vehicle a registration mark approved by the director. The director may approve, as a registration mark, any mark similar to that assigned to the vehicle by the branch of the armed forces in which the vehicle was used; if such a mark is not used, the director shall designate a registration mark consisting of numbers, letters, or numbers and letters in combination at least 2 inches in height. To the extent possible, the location and design of the registration mark shall conform to the official military design and markings of the vehicle.
V. It shall be a violation for any person to drive or any owner or custodian to knowingly permit or cause to be driven a vehicle registered as an antique former military vehicle for any purpose other than those permitted by subparagraph II(a).
VI. The provisions of this section shall not apply to an antique former military vehicle if it is to be used for any purpose other than exhibitions, club activities, parades, and other functions of public interest.
3 Effective Date. This act shall take effect January 1, 2002.
