STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand
AN ACT relative to veterinarian reimbursement for the animal population control program.
Be it Enacted by the Senate and House of Representatives in General Court convened:
134:1 Pet Population Control Program; Veterinarian Participation; Cost Reimbursement. Amend RSA 437-A:4 to read as follows:
437-A:4 Veterinarian Participation.
I. Any veterinarian licensed in this state may participate in the program established under this chapter. A veterinarian shall file with the commissioner an application on which such veterinarian shall supply, in addition to any other information requested by the commissioner, [an animal sterilization] a fee schedule listing the fees charged for animal sterilization, examination, and the presurgical immunizations specified in RSA 437-A:4, II(b) in the normal course of business. [These fees] The animal sterilization fee may vary with the animal's weight, sex and species. The commissioner may, however, disqualify from participation in the program any veterinarian whose fees are deemed unreasonable.
II.(a) The commissioner shall reimburse, to the extent funds are available, participating veterinarians for 80 percent of the fee, less payment paid by the owner to the veterinarian as provided in RSA 437-A:3, for each animal sterilization procedure administered. To receive this reimbursement, the veterinarian shall submit an animal sterilization certificate which shall be signed by the veterinarian and the owner of the animal.
(b) For all animals sterilized under RSA 437-A:3, II, the commissioner shall also reimburse, to the extent funds are available, any licensed veterinarian of this state participating in such program for an examination fee and the presurgical immunization of dogs against rabies, distemper, hepatitis, leptospirosis, and parvovirus, or an examination fee and the presurgical immunization of cats against rabies, feline panleukopenia, calici, pneumonitis and rhinotracheitis, as the case may be. Reimbursement for the full cost of the presurgical immunization shall be [no more than $15,] made by the commissioner to the participating veterinarian upon the written certification, signed by the veterinarian and the owner of the animal, that the immunization has been administered. There shall be no additional charges to the owners of animals sterilized under RSA 437-A:3, II for examination fees or the presurgical immunization. Owners of animals sterilized under RSA 437-A:3, I who have adopted such animals from shelters shall pay the cost of all presurgical immunizations and examination fees directly to the participating veterinarian.
134:2 Effective Date. This act shall take effect 60 days after its passage.

SB 443-FN - FISCAL NOTE
AN ACT relative to veterinarian reimbursement for the animal population control program.
FISCAL IMPACT:
The Department of Agriculture indicates this bill will increase state restricted expenditures by an indeterminable amount in FY 2000 and each year thereafter. There is no fiscal impact on state, county, and local revenue or county and local expenditures.
METHODOLOGY:
The Department could not determine the fiscal impact of this bill on the Animal Population Control Fund because the fee for pre-surgical immunization will be determined at a later time by the Commissioner of Agriculture, and the number of immunizations to be done within the provisions of this bill are unknown.
