STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand

AN ACT relative to the use of nonlapsed funds by the regional community-technical colleges.

Be it Enacted by the Senate and House of Representatives in General Court convened:

209:1 Regional Community-Technical Colleges; Use of Nonlapsing Funds Amended. Amend RSA 188-F:14-c to read as follows:

188-F:14-c Nonlapsing Account. Notwithstanding any other provision of law to the contrary, revenue received in excess of the legislative estimates in the technical education and vocational training divisions of the New Hampshire regional community-technical institute and colleges, as well as net unexpended general fund appropriation balances at the close of the fiscal year, shall be placed in a continuing nonlapsing account. Funds in this account may be used only with the prior approval of the fiscal committee and with the approval of the governor and council in order to establish or enhance, or both, program offerings that will meet the needs of both the student and business and industry with the greatest degree of effectiveness and responsiveness, or to allow the regional community-technical colleges to offset the detrimental impact of unforeseeable or emergency financial circumstances. If the legislative revenue estimates are not met for a fiscal year, then effective the immediate year following, the commissioner, upon prior approval of the fiscal committee and the governor and council, shall notify the bureau of accounts as to which line item appropriations, in which functional units and the specific amounts to be reduced in order to compensate completely for the prior fiscal year's revenue deficit or shall utilize such funds as may be available in the continuing nonlapsing account to satisfy all or a portion of such deficit.

SB 392-FN - FISCAL NOTE

AN ACT relative to the use of nonlapsed funds by the regional community-technical colleges.

FISCAL IMPACT:

The Department of Regional Community-Technical Colleges indicates this bill will have no fiscal impact on state, county and local revenue or expenditures.

METHODOLOGY:

The Department states that currently expenditures arising from the detrimental impact of unforeseeable or emergency financial situations are paid by the Department, and any deficit caused by such payments is addressed by the Department, reducing subsequent year expenditures or by utilizing funds in the nonlapsing account. This bill would allow the Department to seek Fiscal Committee and Governor and Council approval to use funds in the nonlapsing fund at the time the expenditures are made. The amount of state expenditures would not change.
