AN ACT exempting certain portions of Seabrook Beach Village District and certain portions of Hampton Beach from certain provisions of the excavating, filling, and construction permit laws.

This bill exempts certain portions of Seabrook Beach Village District and certain portions of Hampton Beach from the provisions of the excavating and dredging permit laws that require a permit to destroy, raze, deface, reduce, alter, build upon, or remove any sand or vegetation from any sand dune.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord One Thousand Nine Hundred and Ninety-Nine
AN ACT exempting certain portions of Seabrook Beach Village District and certain portions of Hampton Beach from certain provisions of the excavating, filling, and construction permit laws.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Fill and Dredge in Wetlands; Permit Exemption; Portions of Seabrook Beach Village District and Portions of Hampton Beach. Current lots of record in the following locations shall be exempt from the permit requirements of RSA 482-A:3, VII, relative to sand dune jurisdiction only:
I. In Seabrook Beach Village District, those lots established prior to January 1, 1998 and located west of Ocean Drive or Atlantic Avenue, and east of Route 1-A south to Haverhill Street.
II. In Hampton Beach, those lots of record located south of Thornton or Campton Street to the Seabrook town line, and west of Ocean Drive and east of Route 1-A; those lots located south of Route 51, and west of Ocean Boulevard, and east of Battcock, Brown, and Ashworth Avenues; those lots west of River Avenue and north of Epping Street and east of Ocean Boulevard; those lots which are more than 100 feet from the highest observable tide line on Hobson, Manchester, and Keefe Avenues, Mooring Driver, Auburn Avenue, Auburn Avenue Extension, Perkins and Johnson Avenues, Riverview Terrace, Bragg, Tuttle, Fellows, Dow, Harris, and Dustin Avenues.
2 Effective Date. This act shall take effect 60 days after its passage.
