STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand
AN ACT relative to boat fees.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Findings and Purpose. The general court finds that:
I. Many existing boat engines release 20 to 30 percent of their fuel consumed directly to the water, creating undesirable amounts of both water and air pollution.
II. Boats registered in the state should be encouraged with financial incentives to acquire engines that meet new and future environmental standards as expeditiously as possible, and to replace those that do not, without mandating scrappage of all existing boats.
2 New Paragraph; Taxation; Boat Fee; Amount of Fee; Adjustment. Amend RSA 72-A:3 by inserting after paragraph V the following new paragraph:
VI.(a) In this paragraph:
(1) "Eligible boat" means:
(A) Any boat with an engine that complies with all current requirements that the United States Environmental Protection Agency has placed on all boat engines, and all requirements for model year 2007 new boat engines;
(B) Any boat with no engine; and
(C) Any boat with an engine which is designed for only emergency use and which is used for only emergency use.
(2) "New boat amount" means the amount shown in the column labeled "New" in paragraph I for that type of boat, regardless of the age of the boat.
(3) "Non-eligible boat" means any boat which is not an "eligible boat."
(b) The boat fee indicated in paragraph I shall be adjusted as follows, except that no decrease shall decrease a boat fee to less than $10:
(1) Effective January 1, 2003, the boat fee for each non-eligible boat shall be increased by one percent of the new boat amount, and the boat fee for each eligible boat shall be decreased by 9 percent of the new boat amount.
(2) Effective on the first day of the first month at least 90 days after certification to the secretary of state by the commissioner of the department of safety that during the previous 6 months the sum of all adjustments made pursuant to subparagraph (1) have resulted or would have resulted in a sum of less than zero, subparagraph (1) shall no longer apply and the boat fee for each non-eligible boat shall be increased by 2 percent of the new boat amount, and the boat fee for each eligible boat shall be decreased by 8 percent of the new boat amount.
(3) Effective on the first day of the first month at least 90 days after certification to the secretary of state by the commissioner of the department of safety that during the previous 6 months the sum of all adjustments made pursuant to subparagraph (2) have resulted or would have resulted in a sum of less than zero, subparagraph (2) shall no longer apply and the boat fee for each non-eligible boat shall be increased by 4 percent of the new boat amount, and the boat fee for each eligible boat shall be decreased by 6 percent of the new boat amount.
(4) Effective on the first day of the first month at least 90 days after certification to the secretary of state by the commissioner of the department of safety that during the previous 6 months the sum of all adjustments made pursuant to subparagraph (3) have resulted or would have resulted in a sum of less than zero, subparagraph (3) shall no longer apply and the boat fee for each non-eligible boat shall be increased by 6 percent of the new boat amount, and the boat fee for each eligible boat shall be decreased by 4 percent of the new boat amount.
(5) Effective on the first day of the first month at least 90 days after certification to the secretary of state by the commissioner of the department of safety that during the previous 6 months the sum of all adjustments made pursuant to subparagraph (4) have resulted or would have resulted in a sum of less than zero, subparagraph (4) shall no longer apply and the boat fee for each non-eligible boat shall be increased by 8 percent of the new boat amount, and the boat fee for each eligible boat shall be decreased by 2 percent of the new boat amount.
(6) Effective on the first day of the first month at least 90 days after certification to the secretary of state by the commissioner of the department of safety that during the previous 6 months the sum of all adjustments made pursuant to subparagraph (5) have resulted or would have resulted in a sum of less than zero, subparagraph (5) shall no longer apply and the boat fee for each non-eligible boat shall be increased by 10 percent of the new boat amount.
(c) The commissioner of the department of safety may make more than one of the certifications specified in subparagraph (b) at a single time.
3 Effective Date. This act shall take effect July 1, 2002.

HB 1479-FN-LOCAL - FISCAL NOTE
AN ACT relative to boat fees.
FISCAL IMPACT:
The Department of Safety has stated this bill may result in an indeterminable decrease in state restricted revenue and local revenue in FY 2003 and each year thereafter. There will be no fiscal impact on county revenue or on state, county and local expenditures.
METHODOLOGY:
The Department indicated this bill establishes financial incentives in the form of reduced boat fees for boat owners that may result in reduced boat fee income to the state navigation safety fund and local treasurers. The Department is unable to estimate the number of boats with engines that comply with the U. S. Environmental Safety Agency requirements.
