AN ACT relative to processing applications under the medicaid waiver.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Long-Term Care. Amend RSA 151-E:3 by inserting after paragraph II the following new paragraph:
III. The department shall determine and notify an applicant to the medicaid waiver whether he or she is eligible for services under that program within 21 days of the applicant initiating an application. Unless a longer retroactive period is required under medicaid law, applicants determined eligible for services under the medicaid waiver program shall be covered for eligible services provided by a medicaid-approved provider back to the date of the initial application. Upon filing an application, the department shall notify the applicant that, if found eligible, services provided only by medicaid providers shall be covered back to the date of application. If the department fails, at no fault of the applicant, to determine eligibility within the 21-day period, the department shall cover medicaid waiver like services provided by an approved medicaid provider between the 22nd day after initiating an application and receipt by the applicant of a notice of denial for the medicaid waiver.
2 Effective Date. This act shall take effect 60 days after its passage.
