AN ACT relative to child support payments.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Child Support; Application of Child Support Payments for the Benefit of Child. Amend RSA 458:17 by inserting after paragraph VII-a the following new paragraph:
VII-b. (a) All court-ordered child support payments made by the obligor shall be used by the obligee exclusively for the health, benefit, and general welfare of any child or children involved.
(b) Every 6 months after the initial receipt of court-ordered child support payments, the obligee shall provide to the court, and to the obligor, a duly sworn accounting of the disposition of all child support payments received during the preceding 6-month period.
(c) If the accounting provided by the obligee demonstrates that the obligee has failed to use such payments for the health, benefit, and general welfare of the child or children involved, the court, sua sponte may require a hearing on the matter, or the obligor may petition the court for a hearing on the matter. The court shall issue written findings on the matter which shall be admissible in a subsequent proceeding for modification of child support.
(d) In any proceeding on the use of court-ordered child support payments as set forth in subparagraph (c), the court may order that any moneys which the court determines have not been used for the health, benefit, and general welfare of the child or children involved, plus up to 100 percent of such amount, be placed by the obligee in an interest-bearing trust account listing the child or children as beneficiaries. The court may order the obligee to make installment payments of such moneys payable to the trust account.
(e) For the purposes of this paragraph, "obligor" shall be as defined in RSA 458-C:2, VII, and "obligee" shall be as defined in RSA 458-C:2, VIII.
2 Effective Date. This act shall take effect January 1, 2001.
