STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand
AN ACT establishing a program of acting service awards to state employees who temporarily perform the duties of a higher level agency position.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; Acting Service Awards. Amend RSA 99-E by inserting after section 6 the following new subdivision:
99-E:7 Acting Service Awards. In lieu of additional pay on a temporary basis, an acting service award may be granted to a state employee required or requested to perform the duties of a higher level position in an agency due to the incumbent's prolonged absence or departure from service in the position. The acting service awards program shall be administered as follows:
I. An employee who performs the duties of a vacant position in a higher salary grade when there are no reasonable alternatives to filling the vacant position, may submit a request to the agency head responsible for the position for an acting service award. Such a submission may also be made by the employee's supervisor.
II. An acting service award shall not be used as a recruitment method for an employee eligible to be promoted to the vacant position, and shall not be requested until the employee performs the duties of the vacant position for 60 days.
III. The agency head may approve the acting service award if:
(a) The position is essential to agency operations;
(b) Recruitment for the position has commenced or was not feasible due to funding limitations;
(c) Assumption of the duties by another employee at the higher salary level was not acceptable; and
(d) Other agency employees were afforded an opportunity to express their interest in the assignment.
IV. The amount of an acting service award shall be the equivalent of 2 salary steps of the employees current salary level for the applicable period, provided the salary level does not exceed one salary step less than the employee would receive if promoted into the vacant position.
V. The director of the division of personnel, department of administrative services, is authorized to make such funds available from the employee benefit adjustment account established in RSA 9:17-c which are necessary to fund the acting service awards granted by an agency head pursuant to this section. The agency head shall certify any such amounts to the director of personnel for transfer and payment to the employee.
2 Effective Date. This act shall take effect 60 days after its passage.

HB 1367-FN - FISCAL NOTE
AN ACT establishing a program of acting service awards to state employees who temporarily perform the duties of a higher level agency position.
FISCAL IMPACT:
The Department of Administrative Services indicates this bill will have an indeterminable increase in state expenditures in FY 2000 and each year thereafter. There is no fiscal impact on state, county, and local revenue or county and local expenditures.
METHODOLOGY:
The Department states that this bill is permissive, establishing a program for employees who temporarily perform the duties of a higher level agency position. The Department cannot determine how many agency heads will utilize this option and therefor, the Department cannot determine the extent that state expenditures will increase.
