HB 1346-FN - FISCAL NOTE
AN ACT relative to certain acts of felonious sexual assault.
FISCAL IMPACT:
The Administrative Office of the Courts (AOC), the Judicial Council and the Department of Corrections are unable to determine the fiscal impact on state expenditures in FY 2001 and each year thereafter. There will be no fiscal impact on county and local expenditures or state, county, and local revenue.
METHODOLOGY:
The AOC stated this bill will have little, if any, fiscal impact on the Branch in that creating an exception to felonious sexual assault on persons between the age of 13 and 15, where the age differential is four years or less, will not significantly impact caseload.
The Judicial Council is unable to determine the fiscal impact of this legislation, as it is unclear if this new exception is still a Class B felony, or a misdemeanor.
The Department of Corrections is unable to determine how many individuals would be sentenced to state prison as a result of this bill. The average cost of incarceration for FY 1999 was $19,388 per inmate. The average cost of probation/parole supervision for FY 1999 was $842 per offender.
The Department of Justice stated this bill will have no fiscal impact on the Department.
