STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand
AN ACT relative to participation by minors in certain athletic activities.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Purpose and Intent. The general court finds that:
I. Certain athletic activities present a substantial risk of serious injury or death as a result of blows purposefully delivered to the head of the participants involved.
II. Children and teen-aged participants, whose physiological development is incomplete, are particularly susceptible to traumatic injuries to the head in the course of certain athletic activities. Athletic activities whose object involves the purposeful striking of the head of any participant involved are hereby deemed to be inherently dangerous to children and teenagers involved in such activities.
III. It shall be the public policy of this state to prohibit minors from participating in inherently dangerous athletic activities of this sort. By this act, the general court seeks to minimize and, if possible, eliminate the foreseeable risk of such injury to minors from participation in such athletic activities.
2 New Chapter; Safety of Minors in Athletics. Amend RSA by inserting after chapter 285 the following new chapter:
CHAPTER 285-A
285-A:1 Definitions. In this chapter:
I. "Athletic activity" means a sporting event, game, contest, or other athletic competition, including related training or practice sessions, conducted in this state, whether or not the same is sanctioned by an official league or other organizing body.
II. "Minor" means any child under the age of 18.
285-A:2 Participation by Minors in Certain Athletic Activities Prohibited. No minor shall be permitted to participate in any athletic activity whose object is to cause, induce, or otherwise encourage the direct and purposeful striking of the head of another participant in such activity.
3 Effective Date. This act shall take effect 60 days after its passage.
