Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Marijuana Possession and Cultivation Legalized for Certain Medicinal Purposes. Amend RSA 318-B:10, VI to read as follows:
VI. Notwithstanding any other law to the contrary, an attending physician, in good faith and in the course of the attending physician's professional practice only, may prescribe [and administer federal Food and Drug Administration approved and classified cannabis-type drugs, or the attending physician may cause such drugs to be administered by a nurse or intern under such physician's direction and supervision] marijuana to a patient whom the physician has determined would benefit from the use of marijuana in the treatment of cancer, anorexia, AIDS, chronic pain, spasticity, glaucoma, arthritis, migraine, or any other illness for which marijuana provides relief. The provisions of this chapter prohibiting the possession and cultivation of marijuana shall not apply to a patient, or to a patient's primary caregiver, who possesses or cultivates marijuana for the personal medical purposes of the patient pursuant to the written prescription of a physician. In this paragraph, "primary caregiver" means the individual designated by the patient who consistently assumes responsibility for the housing, health, or safety of that patient.
