I oppose SB 552 because it creates broad statutory carve-outs that permit differential treatment based on “biological sex” in ways that undermine New Hampshire’s longstanding commitment to equal dignity and nondiscrimination. While the bill frames these classifications as “limited circumstances,” the language is expansive and would allow public and private entities to exclude or segregate individuals in bathrooms, locker rooms, athletics, prisons, and treatment facilities. This approach risks harming transgender and gender-nonconforming residents, weakening civil-rights protections, and introducing ambiguity into RSA 354-A, which has served the state well as a clear and inclusive nondiscrimination framework. New Hampshire can protect privacy and safety without creating new statutory exceptions that open the door to discrimination.
