RSA 4:46 is an emergency power law that, though never utilized to date, has the potential to be abused by a future governor in a future emergency situation. It grants the governor the ability to take any private property via eminent domain. The bill makes it very expensive to seize private property and thus less likely for that power ever to be utilized.
