Thank you for the opportunity to testify. I respectfully oppose HB 1299. This bill creates broad new exceptions within New Hampshire’s Law Against Discrimination by permitting public and private entities to classify individuals by “biological sex” in multi-user facilities and by declaring that these distinctions do not constitute discrimination. Embedding these carve-outs in RSA 354-A weakens the clarity and consistency of our civil-rights framework and risks undermining existing protections for transgender and gender-nonconforming residents. The bill invites uneven implementation across schools, businesses, and municipalities, and it creates uncertainty for organizations that must comply with both state and federal nondiscrimination requirements. Rather than improving safety or privacy, HB 1299 introduces ambiguity into a statute that has long provided clear, stable protections for all Granite Staters.
