History shows that governments cannot erase truth by statute. Removing the “X” designation from state-issued identification will not make nonbinary people disappear. It will only make their lives harder. HB 1165 does not make anyone safer, and it does not solve a real problem. State identification exists to accurately reflect who people are for legal and administrative purposes. Eliminating an option that already functions in practice substitutes ideology for governance and imposes harm without benefit. New Hampshire should not use the power of the state to deny recognition to a small and vulnerable group of its residents.
