I strongly oppose HB 1203-FN. This bill undermines judicial discretion by limiting a judge’s ability to require a background check before firearms are returned following a dismissal or not-guilty verdict. Courts must retain the authority to assess current risk, not be forced to blindly return weapons without updated safety checks. This proposal chips away at commonsense safeguards and places convenience above public safety—an unacceptable trade-off.
