The argument against this is always that the constitution does not apply to undocumented immigrants, however ArtI.S8.C18.8.7.2 Aliens in the United States states that once an alien lawfully enters and resides in this country he becomes invested with the rights guaranteed by the Constitution to all people within our borders.
