Testimony Exposing Harmful Underpinnings of HB 1387 I strongly oppose HB 1387, which seeks to repeal the existing limitations on liability for certain design features of firearms. This bill undermines the critical balance that has been established in promoting both public safety and the responsible manufacturing of firearms. By removing this legal protection, we risk opening the floodgates for frivolous lawsuits against firearm manufacturers, which could drive up costs for consumers and impede innovation in the firearms industry. Manufacturers could become overly hesitant to develop and improve designs, fearing litigation over features that might unintentionally contribute to misuse or criminal activity, thus compromising safety advancements and responsible gun ownership. Moreover, this repeal suggests a fundamental misunderstanding of the complexities surrounding gun violence and firearm safety. It incorrectly places the burden of liability solely on manufacturers, detracting attention from the more significant societal issues that drive gun violence, such as mental health, lack of education in safe gun handling, and insufficient support systems. This approach fails to address the root causes of gun violence while potentially harming responsible gun owners and manufacturers who prioritize safety and compliance. Instead of focusing on punitive measures against manufacturers, we should be advocating for comprehensive solutions that enhance community safety without jeopardizing the livelihood of responsible businesses or infringing on individual rights. The passage of HB 1387 could inadvertently exacerbate the very problems it seeks to address, making it a harmful legislative pursuit.
