CACR2 relates to the drawing of district boundaries and would provide that no district boundaries shall be drawn in a way that favors or disfavors any political party or candidate. The New Hampshire Constitution Part Second, Article 9 Apportionment of Representatives states that "every ten years, the legislature shall make an apportionment of representatives according to the latest general census.." Any such effort conducted by a partisanly elected legislature will reflect the partisan make-up of the group at some level. This bill would attempt to outlaw any such bias, whether subtle or egregious, and enshrine unelected courts as the arbitrator of whether any reapportionment is sufficiently "non-partisan," a position superior to that of the elected legislature.
