I am opposed to HB 410 because of its vagueness, and the expense it would impose on municipalities. What constitutes "empirical evidence published by a non-partisan source?" Is it a government report, a town's or city's master plan? If a municipality hired a consultant to study a local problem and then sought to implement the study's findings, could that study be relied upon by. the municipality to demonstrate direct necessity? What constitutes direct necessity for the health and safety of the community? The vagueness of these terms is an invitation to appeal and litigation, the defense of which would impose a significant financial burden on municipalities.. Does Section II., (c) prohibit regulation of lot size, setbacks and height restrictions on residences in commercial districts without empirical evidence? Is a car repair business in an attached garage an in-home business? What about a high volume retail business? Allowing camping on residential properties poses a sewage disposal threat.
