THE COMMITTEE ON Education

to which was referred HB 532

AN ACT relative to alternative dispute resolution and individualized education plan team meeting facilitation.

Having considered the same, the committee recommends that the Bill

OUGHT TO PASS WITH AMENDMENT

BY A VOTE OF: 5-0

AMENDMENT # 2156s

Senator Suzanne Prentiss

For the Committee

HB 532 clarifies the role of individualized education program (IEP) team meeting facilitation by distinguishing it from other forms of alternative dispute resolution (ADR) like mediation and neutral conferences. The bill establishes a 30-day discussion window following a parental rejection of an IEP component and encourages, but does not require, the use of ADR methods. The committee amendment reorganizes RSA 186-C:23 to improve clarity and codifies IEP facilitation as a distinct ADR process. It removes redundant language and confirms that such proceedings remain confidential and nonbinding, preserving due process rights.
