STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Sixteen

AN ACT prohibiting a political subdivision from adopting residency restrictions on sex offenders.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1  New Section; Registration of Criminal Offenders; Residency Restrictions Prohibited.  Amend RSA 651-B by inserting after section 12 the following new section:

651-B:13  Residency Restrictions Prohibited.  No political subdivision of the state shall adopt an ordinance or bylaw that restricts in any way the residence of a sexual offender or an offender against children.  Any such ordinance or bylaw adopted by a political subdivision of the state prior to the effective date of this section shall be unenforceable upon the effective date of this section.

2  Effective Date.  This act shall take effect 60 days after its passage.
