Senator Keith Murphy
For the Committee
This bill would require the commissioner of the Department of Labor to give at least 30 days’ written notice before any visit or inspection, including the purpose, complaint status, and alleged violation. This bill also would require at least 30 days for establishments to respond to document or interview demands, regardless of complaint status. With the approval of the Attorney General’s Office, shorter notices would be permitted if an establishment has violated labor laws within the past 36 months; if there is an imminent risk to health or safety; or if it is likely that notice would lead to the destruction or interference of evidence.
