STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand
A RESOLUTION urging the executive branch to negotiate an expedient settlement resolving the Claremont dispute.
Whereas, in 1991 the plaintiffs consisting of 5 New Hampshire towns and school districts, filed a petition for declaratory and injunctive relief challenging the method used by the state of New Hampshire to provide a public education to the children of the state, and the disproportionality of the property taxes levied to pay for such public education; and
Whereas, in 1997, the New Hampshire Supreme Court held the system of financing elementary and secondary public education in New Hampshire to be unconstitutional and ordered the state to create another method of providing and funding public education; and
Whereas, since the Claremont II ruling in 1997, and after debating various education funding alternatives, the state, through the enactment of HB 117, established a new system of funding public education; and
Whereas, in August, 1999, the plaintiffs brought legal proceedings challenging the constitutionality of this new system of funding public education; and
Whereas, prolonged litigation of this matter could have a substantially detrimental impact on the delivery of public education to the children of this state, and as such, should only be considered as a last resort; and
Whereas, it would be in the best interest of the plaintiffs, the state of New Hampshire, and the school children in this state, if the executive branch would negotiate a settlement of this dispute as quickly and expediently as possible; now, therefore, be it
Resolved by the Senate and House of Representatives in General Court convened:
That the executive branch of the state of New Hampshire should negotiate a settlement with the Claremont II plaintiffs to resolve this dispute as quickly and expediently as possible.
That continued litigation of this matter should only be considered as a last resort.
