STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand
AN ACT relative to municipal permits for registration of motor vehicles.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Municipal Permits for Vehicle Registration; Unpaid License or Permit Fees. Amend the introductory paragraph of RSA 261:148 to read as follows:
No vehicle, except an OHRV, snow traveling vehicle or moped, owned or controlled by a resident of this state shall be registered under the provisions of this chapter until the owner or person controlling the same has obtained a permit for registration from the city or town wherein he resides. This section shall not apply to vehicles which constitute stock in trade of a manufacturer or of a bona fide dealer. The town or city clerk shall issue such permits to vehicles exempted from registration fees under RSA 261:92 at no charge. If the town or city has adopted the provisions of RSA 231:130-a, no such permit shall be issued unless the town or city clerk's records reveal no outstanding parking violations in this state. If the town or city has adopted the provisions of RSA 261:148-a, I, no such permit shall be issued unless the town or city clerk's records reveal no outstanding or unpaid license or permit fees owed the town or city pursuant to any section of the Revised Statutes Annotated. No such permit shall be issued unless the owner or person controlling the vehicle presents to the town or city clerk:
2 New Section; Municipal Permits for Vehicle Registration; Unpaid License or Permit Fees; Local Option. Amend RSA 261 by inserting after section 148 the following new section:
261:148-a Unpaid License or Permit Fees; Local Option.
I. Any municipality adopting the provisions of this section pursuant to the procedures in paragraphs II and III shall issue no municipal permit for vehicle registration, except for OHRVs, snow traveling vehicles, or mopeds, to a person unless the town or city clerk's records reveal no outstanding or unpaid license fees owed by the person to the town or city pursuant to any section of the Revised Statutes Annotated. This section shall not apply to vehicles which constitute stock in trade of a manufacturer or of a bona fide dealer.
II. Any town or city may adopt the provisions of paragraph I in the following manner:
(a) In a town, the question shall be placed on the warrant of a special or annual town meeting under the procedures set out in RSA 39:3, and shall be voted on by ballot. In a city, the legislative body may consider and act upon the question in accordance with their normal procedures for passage of resolutions, ordinances, and other legislation. The legislative body of a city may vote to place the question on the official ballot for any regular municipal election, or, in the alternative, shall place the question on the official ballot for any regular municipal election upon submission to the legislative body of a petition signed by 5 percent of the registered voters.
(b) The selectmen or city council shall hold a public hearing on the question at least 15 days but not more than 30 days before the question is to be voted on. Notice of the hearing shall be posted in at least 2 public places in the municipality and published in a newspaper of general circulation at least 7 days before the hearing.
(c) The wording of the question shall be: "Shall we adopt the provisions of RSA 261:148-a, I for the withholding of municipal permits for vehicle registration from persons who have outstanding or unpaid license or permit fees owed the municipality?"
III. If a majority of those voting on the question vote "Yes", RSA 261:148-a, I shall apply within the town or city beginning on that date.
IV. If the question is not approved, the question may later be voted upon according to the provisions of RSA 261:148-a, II.
V.(a) Any town or city which has adopted RSA 261:148-a, I may consider rescinding its action in the manner described in RSA 261:148-a, II(a) and (b). The wording of the question shall be the same as set out in RSA 261:148-a, II(c), except the word "adopt" shall be changed to "rescind."
(b) If a majority of those voting on the question vote "Yes", then beginning on that date, RSA 261:148-a, I shall not apply within the town or city.
3 Effective Date. This act shall take effect January 1, 2001.
