AMENDED ANALYSIS

 

This bill shifts rulemaking authority for manufactured housing dispute resolution to the office of professional licensure and certification.  It further repeals the rulemaking authority of the installation standards board relative to fees.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to manufactured housing rulemaking authority.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

373:1  Office of Professional Licensure and Certification; Rulemaking Authority.  Amend RSA 310:6, II to read as follows:

II.  Such organizational and procedural rules necessary to administer the boards in the office, including rules governing the administration of complaints and investigations, hearings, disciplinary and non-disciplinary proceedings, manufactured housing dispute resolution, inspections, payment processing procedures, and application procedures.  For purposes of this paragraph, "manufactured housing dispute resolution" means a program for the timely resolution of disputes between manufacturers, retailers, and installers of manufactured homes, including the issuance of appropriate orders, regarding responsibility for the correction or repair of defects in manufactured homes for defects that are reported during the one-year period beginning on the date of installation.

373:2  Repeal.  RSA 205-D:20, VII, X, and XI, relative to manufacturing housing installation standards rulemaking authority, is repealed.

373:3  Contingency.  If SB 318 of the 2024 general legislative session becomes law, section 2 of this act shall not take effect.  If SB 318 does not become law, section 2 of this act shall take effect 60 days after its passage.

373:4  Effective Date.  

I.  Section 2 of this act shall take effect as provided in section 3 of this act.

II.  The remainder of this act shall take effect 60 days after its passage.
